Kibaki’s Children Oppose DNA Test Request in Wealth Dispute with Two Persons Claiming to be His Offsprings

The late former President Mwai Kibaki’s four children have opposed a request for a DNA test to confirm whether they are siblings with two persons, who are claiming a share of their dad’s wealth.

Judy Wanjiku, Jimmy Kibaki, David Kagai and Antony Githenji have cited a violation of their privacy and want the court to dismiss the request by Jacob Ocholla and a woman codenamed JNL seeking orders for sibling and paternity DNA tests.

Ocholla and JNL, who claim they were sired by Kibaki, moved to court following his death in April and are claiming a stake in his wealth. They want to be recognized as his children and beneficiaries of his multi-billion-shilling estate.

In the first prayer, the two want the court to order a sibling or paternity DNA test to establish whether they are children of the late president. Alternatively, they have sought orders for the exhumation of Kibaki’s body for extraction and collection of samples to be used in a DNA paternity test.

Ocholla’s lawyer Morara Omoke told the court that there are no known DNA samples of Kibaki that have been stored in a data bank or any other facility, hence exhumation is the only option for a paternity test.

But in a response filed in court, Kibaki’s four children opposed the DNA test request and sharing of Kibaki’s wealth with Ocholla and JNL. They have disputed the parentage of Ocholla and JNL, saying Kibaki never introduced the two to his family during his lifetime.

Last month, Justice Maureen Odero referred the succession matter for mediation. She directed Ochola, Wanjiku, Jimmy, Kagai and Githinji to mediate the dispute relating to DNA paternity testing.

The judge further ordered full disclosure of all documents to parties, particularly the Will and the list of all assets belonging to Kibaki, who died in April aged 90. 

In a six-page will signed in 2016, Kibaki shared his undeclared wealth equally among his four children.

True mere physical resemblance does not equate to blood relation.But when you factor in the fact that Kibaki had an affair with Ocholla's mother and according to his own account he met Kibaki several times,then the resemblance takes a more "bloody connection".Now what remains is the DNA to say so.
You would think that KIbaki's kids for the sake of closure,and disclosure would be more welcoming to the DNA testing.If nothing else to avoid the woulda , coulda shoulda situation in future,and to put the whole "mystery" to rest.
Unfortunately, this is all playing out because Kibaki left some considerable amount of WEALTH.Had he died destitute,I highly double if Ocholla,and JNL would be in the news today...
If i had a part to play in this quagmire I would tell Kibaki's 4 kids, in the will ,to trade places with Ocholla,and JNL...,and see if they would think differently.This of course is hypothetical, reality is a totally different animal,when it comes to splicing the pie.

Why not? we are all human and bound to be overcome by the lust of sex at one point is a phenomenon - Moi, Kenyatta and you name it did. You who reads this to have do it or will soon happens. So let the test be done and they get at least something to move on in life

If they refuse then the next step is exhumation of the body.Just submit your DNA when you hesitate you are just encouraging more of them to come out of the woodwork.As soon as he died one came out now they are two soon it will be a village .Act when the iron is still hot and resolve this matter so that you will be left with some thing for yourselves

The actions we take as adults sometimes comes to haunt our children. But from the stories we heard about Lucy [RIP] Kibaki turned to alcohol and women, if she was slapping folks at statehouse, think about what Mwai was going through. If she was this tough, mzee akinyimwa lazima he had to look for some release somewhere, now, with alcohol involved, using the smaller and frustrated, this was bound to happen.
His kids are pissed off for sure,but they also have to understand what kind of a father they had. They need to suck it up and do the DNA. But with money involved, it's unlikely this will happen.
Let's go back a few years back, did it happen after Saitoti died?
