The United States has reiterated that B1 and B2 visitor visas may only be used for short-term business and tourism, warning foreign nationals against using them for activities outside their authorised purposes.

The B1 and B2 categories remain widely used by foreign visitors travelling to the US. However, the visas do not permit holders to engage in activities that require a different immigration status. 

Under the rules, visitors may not enrol in academic studies, take up employment or perform for a paying audience. They are also prohibited from entering the US as crew members on ships or aircraft, working as journalists or in the media, seeking to establish permanent residence, or travelling primarily to give birth in order to obtain US citizenship for their child.

US immigration authorities have warned that violations can have serious consequences. Under Section 222(g) of the Immigration and Nationality Act, overstaying or engaging in prohibited activities can result in the automatic cancellation of a visa. 

A cancelled visa can make future applications subject to greater scrutiny and may affect an individual's ability to obtain permission to enter the US. There are limited options for people whose circumstances change after entering the country. 

For example, a person who marries a US citizen or receives a job offer may, where eligible, apply through the US Citizenship and Immigration Services to change or adjust their immigration status without leaving the country. However, leaving the US does not allow the person to return using the original visitor visa if a different status is required. They must obtain a new visa in the appropriate category before travelling back.

For Kenyans planning to visit the US, the rules underline the importance of using a B1 or B2 visa only for activities permitted under that status. Visitors who intend to study, work or pursue another long-term purpose should apply for the appropriate immigration category rather than relying on a visitor visa.
