US Introduces Fixed Stay Limits for International Students

New US immigration rules taking effect on 15 September 2026 will replace the long-standing “duration of status” system for international students with fixed admission periods.

Under the current system, F-1 students can remain in the US while maintaining valid enrolment and authorised training, followed by a 60-day grace period after completing their studies. From 15 September, admission will instead be linked to the programme length stated on Form I-20, subject to a maximum of four years. 

Students will still be allowed to enter the US up to 30 days before their programme begins, but the post-study grace period will be reduced to 30 days. The new rules will also set specific limits for certain groups. Students enrolled in English language programmes will be admitted for a maximum of 24 months, while public high school students will be limited to 12 months. These periods will include breaks and holidays.

Students who need more time to complete their programmes will face additional requirements. They may apply for an Extension of Stay (EOS) through US Citizenship and Immigration Services (USCIS), using an updated Form I-20 and Form I-539, which requires payment of fees and biometrics. Students with valid visas may instead leave the US and seek a new admission period when they return, subject to review by US Customs and Border Protection (CBP).

The changes will also affect students who travel outside the US. F-1 students returning after 15 September will receive a new fixed admission period based on their updated Student and Exchange Visitor Information System (SEVIS) record and supporting documents.

A transition provision will apply to some students already in the US when the new rules take effect. Those who are eligible and submit timely applications for post-completion Optional Practical Training (OPT) or STEM OPT by 18 March 2027 will not be required to file an EOS under that provision.

The new system will replace the open-ended admission period with defined timelines and additional compliance requirements. International students will therefore need to monitor their authorised stay, programme dates and applications more closely under the revised rules.
