Court Revokes Freezing of Kalonzo Musyoka Foundation's Bank Accounts

The High Court on Thursday revoked the decision by the Non-Governmental Coordination board to freeze bank accounts belonging to Kalonzo Musyoka Foundation.
In its ruling, the court said that the NGO Coordination board acted illegally in suspending the operations, dissolving the board and freezing bank accounts of the foundation.
Justice Roselyn Aburili said the directive by the CEO of the board, Fazul Mahamed was overboard and illegal and declared it null and void.
The court further established that Fazul-led board had cleared the foundation for operation three weeks before issuing the directive to suspend its operations.
“In this case the directive was issued indefinitely and as such even if the complainant filed an appeal before the cabinet secretary, there was no time to be heard therefore the only help then could come from the court,” read the ruling in part.
The court further ruled that the NGO board CEO has no powers to suspend operations of an NGO, but can only alert the investigating bodies who can then make recommendations depending on their findings.
The board had cited failure by the foundation to account for Sh 196 million as the reason for suspension of its operations.
