MP John Waluke Surrenders Himself to Serve 67-year Prison Sentence

A day after the High Court upheld his 67-year prison sentence, Sirisia MP John Waluke has surrendered himself to police in Nairobi.

Waluke, who was re-elected for a third term in the August 9th general election, took himself to Milimani law courts on Friday, where he was detained awaiting transfer to prison. 

The MP was found guilty of defrauding the National Cereals and Produce Board (NCPB) of Sh297 million alongside his co-defendant Grace Wakhungu, who was sentenced to 69 years in prison.

On Thursday, Justice Esther Maina dismissed the appeal filed by the two, ruling that the charges were proven beyond reasonable doubt, and the sentence is not excessive as it is within the law.

Waluke and Wakhungu were ordered to pay their fines of Sh727 million and Sh707 million respectively, or serve the jail sentences.

The judge concluded that the sum of Sh297,386,505 paid to their trading company, Erad Supplies and General Contractors Limited, by NCPB in 2013 was based on fraud. 

“The invoice upon which the claim for payment was based was a forgery. Mr Waluke presented it to an arbitrator knowing very well Erad Supplies and General Contractors Limited had no dealing with the maker of the invoice (Chelsea Freight Ltd) and as a result it was paid the sums by a public body,” said Justice Maina. 

The trial court heard that the defendants received the funds after their company won a tender to supply 40,000 tons of white maize to NCPB. The tender was however canceled after Erad Supplies failed to prove it had sufficient funds to supply the maize.

The company ended up pocketing Sh297 million after they sued NCPB, arguing that by the time the contract was canceled, they had already procured the maize from Ethiopia and that it had been stored by South African company Chelsea Freight in Djibouti for 123 days.

The two can challenge the verdict at the Appeals Court within 14 days.

Re-elected for a third term what are the voters thinking.Now they will have to go back to the polls and pick yet another thug after they have been bribed.This is the same IEBC that cleared this thug to run again knowing he was charged with fraud.How is Kenya supposed to improve with such thugs .He is smiling knowing he has bribed the judge so that he is granted an appeal and is free to steal more as a mpig in the Ruto administration.

We can use this man to make a small dent on corruption. He knows a lot of crocked corruption shit. Remember, you cannot be corrupt alone. This man walked out of prison and headed to parliament- elected, without a dime to his name. Such is the power of knowing who is knowing who where, and when! We should cut him a deal as long as he starts singing. We need to know who took what money and when. Who is holding land illegally,sold it or is sitting on public land right now - Amos Kimunya style. He can tell on his thieving buddies for a small cut on his long prison term. We need our money back now!

This is a good fight against corruption and hope the rest of similar cases will follow suit. This kind of sentences were taken long ago by countries like Singapore and Malaysia which came to Kenya after its independence to obtain financial loan back in 1965.Now they are not considered to be developing countries by far.

How was Brother Waluke cleared to run for an elective public seat with all his baggage?
SOLUTION
1. Brother Wafula Chebukati should take his place in jail for clearing candidates with shady past to run for public office.
If Chapter 6 of our New Constitution was adhered to, less than 10% of the current elected leaders would have passed the "constitution rigorous test."
2. Don't expect to see any meaningful and profound changes in the future among our elected members of the legislative and executive branches of the government if Brother Wafula Chebukati is still holding the same position that he has in IEBC.

Yes! This is the kind of people, I mean animals, we have become. Look at one Ongili alias Bob Owino he criminally shot an innocent man, Felix Orinda alias DJ Evolve through the neck nearly killed him- destroyed his life forever. Owino is now in parliament and in the streets enjoying life, running his mouth without a care. He is above the law- a free man. Regular Kenyans with similar criminal acts, even much less offence, are rotting in prison. This is pathetic! Welcome to the Kenya you have chosen for yourselves.

We should get out of our ivory tower and get into the fields. Get our hands and feet dirty and muddy as we get into the activists arena. We can pick up three burning issues; it's easy to choose since almost everything is broken up in Kenya. We create a coordinating forum or center. We articulate the issue (s), we break it down, we strategize, we come up with a consensus on how best to bring about the needed change/ cure or outcome. We reach out to the Kenyans and explain ourselves. We show them how the change we propose will change and improve their lives. We use print media, we write to the editor, we pay for space on Kenya's major print media. We pay ad/message slots on radio and TV. Since we have chosen democracy in Kenya, let us use democracy to change minds and help our impoverished majority. In other words, we should move from talking it to doing it. Think about it, for every difficulty or nasty problem: political, corruption, corporate theft, evading paying taxes religion, poor healthcare, immorality etc,; we have solutions, but only in words. Now as someone once said; we want the words that become deeds that meet the needs.
