Drama at JKIA as Miguna Miguna Resists Second Deportation

Drama ensued at Jomo Kenyatta International Airport (JKIA) on Monday night as Kenya immigration officials attempted to deport lawyer Miguna Miguna again to Canada.

Immigration officials say Miguna Miguna was not refused entry as he claimed, but rather that he refused to present the Canadian passport he was traveling on as requested, which created the standoff.

Interior Ministry spokesman Mwenda Njoka in a tweet said all travelers are required by local and international travel regulations to present to immigration officials the documents they traveled with to the point of entry, which Miguna refused to do. “The Government has not denied Miguna Miguna entry into the country. Upon arrival at JKIA he was asked to present the passport he traveled on. He declined," Njoka said in a tweet.

"It is a requirement under the law and International Air Transport Association (IATA) regulations for travellers to show the documents they travelled on at the point of entry,” Njoka added.

After an eight-hour stand-off at JKIA, a group of police officers and immigration officers forced the National Resistance Movement (NRM) self-declared general into a Dubai-bound Emirates flight.  Miguna however resisted the move and disembarked from the plane, saying ““I am not going anywhere….where is my luggage? Where is my passport? You cannot take me from my country by force.”

The flight, which had already been delayed by the commotion, left without Miguna.

Cliff Ombeta, Miguna’s lawyer, had earlier in the day said that the government wants his client to enter the country on a temporary visa as a foreigner rather than as a Kenyan so that the government can declare him to be illegally in the country when his visa expires.

"They want him to take a temporary visa so that he becomes stateless when it expires. We have advised him not to sign the papers. They are now consulting their seniors,” Mr Ombeta told journalists.

Miguna was initially deported to Canada six weeks ago after the Interior Ministry said he was in the country illegally. The government said Miguna was in illegal possession of a Kenyan passport after having abandoned his Kenyan citizenship by becoming a Canadian citizenship. The government said following the promulgation of the new constitution that allows for dual citizenship, Miguna is eligible to regain his Kenyan citizenship by submitting an application to the Immigration department, but that he had not done so at the time of his deportation and should not have entered the country on a Kenyan passport.

Miguna had a valid Kenyan Passport before he was deported to Canada. The people who took away Miguna's valid passport have a legal and moral obligation to give him back a valid Kenyan Passport.

@Sokora, you are missing the legal implication of him presenting a Canadian passport. The government wan't to categorically treat him as an immigrant, hence, lacks citizenship benefits. Remember 1. He had a right to be tried in kenyan courts or forgiven just like 'baba' and perhaps join the coalition government like other Nasa supporters. dhambi zote ni sawa. 2. As per the constitution/law, his passport confiscation was illegal, he is a Kenyan Citizen.. 2. His passport was mutilated by the said government officials. 3. The judicial system deemed his deportation and maltreatment as illegal and the courts ordered that he be given a new passport. Now tell me, it took me less than a week to renew my passport, why has the government not renewed his passport? Isn't this a calculated move to restrict him? Rao ako na nani sasa? so why double standards?

XG, If you cannot beat them, join them. Miguna can fight all he wants but at the end he is getting nowhere. He just needs to comply; he is not the only diaspora resident Kenya has. There are many and as such, neither Miguna nor others in Disapora need special treatment. Even you, you cannot enter a country with an photo ID without presenting a passport unless you skim the borders; and that turns you into an illegal alien.

Miguna got what he wanted be dramatic as possible and get coverage of this week. He has been practicing what to do to make the show more enjoyable. Next time they will deport you ukiwa na mapingu & security officers.

He is very very foolish!He wasn’t cleared he wanted to pass thru without clearance,he refused to submit the Canadian pp he travelled with coz hana Kenyan pp.Please Guys he need to follow the law n get either a tourist visa or a valid Kenyan pp.Otherwise he cannot win!Nobody ever wins gava n if he continues to push he should b careful juu he has enemies in gava n in opposition starting from raila.I have said it here if the idiot miguna was my fred I will telll him to b careful juu he was safer at Canada!!!

Imara has agood point. They took his Kenyan passport away.The players in the Raila Swearing in have been forgiven and their passports restriction re-instated,and I believe that Includes Miguna.
Iam also curious as to why Miguna is saying"where is my passport"? This sounds like his lawyer is correct that they want him to enter on a foreign visa.His lawyer has advised him not to do so.Why not apply for the temp.visa,and make sure that you renew the visa before it expires,while you find out what happened to your Kenyan passport,since your "sins" have been forgiven.Or have they?

After what I saw at Nairobi International Airport today, I have lost confidence in Kenya as a "democratic nation."

I saw gangs of Mungiki terrorists dressed in police uniform. What a sad day!!! I have absolutely no confidence in Jubilee and NASA political parties. Both Raila and Uhuru are nothing but opportunists in power for their own selfish and myopic goals.

Hopefully, we can wait patiently until 2022 when the Kenyan nightmare will be over! Both Raila, Uhuru and Ruto must exit from the Kenyan politics. That is when Kenya as a nation will be united again as "ONE" the same way it was in 1963.

Maxiley, I disagree with you. I think Miguna flew in with his Canadian passport and refused to ENTER Kenya as a Canadian. The passport he was asking for was the Kenyan one confiscated before. The drama is very sad, lakini law is for everyone. When we travel back home, we see Kenyans who have been naturalized elsewhere queue up for a visa. It's simple, so why should it be different for M.M. Miguna had a bone to pick that's why he was waving his ID at the authorities. I didn't understand why they did not handcuff him instead of allowing him the air time. BTW, this happens everyday in Europe to African people without valid papers. They are put in to the next available flight, handcuffed and are the first to be boarded to spare other passengers any distress. As a human being, I felt sorry for him, but I guess the drama is right up his aisle and plays right into his agenda!!

Well said. I doubt the court granted Miguna lee way to bend the law. He has shown his Canadian passport in all the countries he has traveled through, why not do the same at JKIA? People want their rights respected but they do not want to meet their responsibilities...

Emotions aside and after reflecting on Miguna's action, I feel the state has taken the right decision. First, he relinquished his Kenyan citizenship when he claimed asylum, hence he is a Canadian by naturalization. He should have entered the country via his travel documente he embarked with at the port of departure, then kick a storm after entry by applying for his Kenyan citizenship. He is just an over grown baby holding the nation to ransom - just as he did when he swore Raila in. His intention and bravado are ill placed. If I, (a mere mwanainchi) just breezed in at JKA with my Kenyan ID and demanded to be let in because I walk, quark and look like a Kenyan, I am sure I would be told to stick my ID so high up where the sun does not shine! So why should Miguna be any different from the rest of us plain Janes? He should respect protocol and processes. He keeps saying he is a Lawyer, kwani this profession has no code of conduct? Boy, I would have a lot to answer to if I behaved the way he did outside my work place. Everyone is an enemy as far as Miguna goes, and no one is as intelligent....a very dangerous and lonely place to be. Poor brother.

@sukari read my comments n I clearly started what u just said n thumbs up coz Wr not goijgvwith feelings here.The idiot miguna broke the law n yet as a lawyer n he understands the law have refused to follow or obey the same law?Just because the courts ordered u back doesn’t mean u use yr balls at the point of entry!U use the correct documents!You can the argue yes the gava was told to make use to prepare necessarily documents for him to come back but he decided to bring himself back without waiting for the gava to prepare the documents???He is just foolish n he has no choice but to use his Canada pp to enter which has 6 months tourist visa!Otherwise its very hard for him to win?His big mouth has landed him to this.No wonder Wr called shitholes blacks by trump coz while in USA Canada uk mzungu country we worship n follow their law but hapa nyumbani we don’t want to.We remain niggas n dammm niggass!

Pple have changed, guys have been minding there business which saves lots of unwanted issues. I was like these is really good to see our people revolve ... look 👀 hakuna mtu Alitaka siasa to get in there heads and peace prevailed.
