Miguna Miguna Seeks $10,000 Compensation over Aborted Trip to Kenya

Kenyan-Canadian attorney Miguna Miguna has sued Foreign Affairs CS Raychelle Omamo over his failed trip to Kenya.

Miguna, who was deported to Canada in 2018, wants CS Omamo committed to civil jail for disobeying a court order requiring the ministry to facilitate his trip to Kenya.

“She has willfully disobeyed the same with impunity and demonstrated callous refusal to comply with it,” reads court documents.

“The actions of the CS are in bad faith contemptuous and a dangerous affront to the proper administration of justice.”

Miguna, in the case filed at the High Court on Tuesday, says he visited the Kenyan Embassy in Berlin, Germany on November 22nd and 23rd last year but officials refused to issue him with an emergency travel certificate as ordered by High Court judge Hedwig Ong’udi.

In addition, Miguna wants the court to order the government, Air Lufthansa, and Air France to compensate him for the over $10,000 he incurred in his aborted trip.

“I spent more than $10,000 on this latest trip. Besides, I spent an equivalent amount in March 2018 and January 2020 when the state prevented me from entering Kenya,” says Miguna.

“I seek severe penal punishment including but not limited to custodial sentences of the contemnors in addition to having them ordered to jointly and severally compensate me for the losses incurred in relation to the aborted trip to Kenya in November.”

Miguna was set to travel to Kenya on November 16th, 2021 but he was barred from boarding a Nairobi-bound France Air flight in Berlin over a red alert allegedly issued by the Kenyan government.

In 2018, Justice Chacha Mwita ruled that Miguna is a Kenyan citizen and that his birthright is not affected by him holding a Canadian passport. The jusge further ruled that Miguna’s rights were violated when they deported him and awarded Sh7 million as compensation.

Miguna reminds me so much of Donald Trump. Both of them have big egos and like to use the court system to fight their private battles. Differences between the two; well, Trump gets donations from his supporters to hire lawyers which of course he never pays them and ends up keeping the millions while our dear Miguna spends all his money in French and German airports.

According to current reporting, "He spent $4,300 on air fare and $3,400 on hotel accommodation, plus transport and necessities such as food and other basic needs.
In addition, he paid $250 to change his flight from Berlin to Toronto. In total, he spent more than $10,000 on the latest trip."
Essentially he chose to fly business class and stay in the swankiest of hotels. How do you spend $3400 in hotels and transportation in less than 5 days and why should Kenyan taxpayers foot the bill for his profligate ways on a trip that was clearly doomed from the start. Now imagine this person as a governor or joining the ranks of government.

I'm not saying he can't afford it. I'm asking why he wants others(Kenyan taxpayers) to foot the bill for his misadventures. This isn't the 1st time he has done this and the results are remarkably similar each time. Each time he has boarded the plane as a Canadian and not a Kenyan. As a lawyer, he knew or should have known the chances of getting to Kenya were slim and none. Unfortunately slim flew back to Toronto when the plane landed in Europe. Like Miguna, I lost my citizenship per the old constitution when I became a US citizen. It would have been nice if I could have regained it automatically but my fellow Kenyans didn't see it that way. I chose to respect their wishes and Kenyan law and did what was necessary to regain it. He should try to get the constitution changed or follow it like the rest of us.

Well, young there we go again with your youngness. Do you know how difficult it is to find this clients who pays anything. Since you are young, let me school you a little bit. A Dr or lawyer can earn however much they want BUT do you know how hard it is to get those clients? Answer is very hard. Those who make money in US/Canada are either truckers, hustlers, or rich people. Also, here in Maai Mahiu where I live, lawyers and Dr makes peanuts. You welcome 😊

Miguna is not entitled to a penny from anyone. He made personal financial decisions. Better homework regarding the prevailing should have deterred him from incurring the costs.

Majambazi Uhuru or Omamo will not compensate Miguna for their deliberate disobedience of court or forced asylum.Hungry billionaire Kenyans will pay him any amount he demands.The guy is earning millions and sympathy support/popularity daily from Uhuru’s UKAMASHI decision-UPUUZI TUPU.I fail to understand how learnt people can support Uhuru & Co.for their senseless decision to eject Miguna.

Miguna is seeking political mileage. The court order was signed while he was in Berlin. By that time, he had already purchased his air ticket to NBO. While he can claim for expenses after the court order, he cannot claim for expenses incurred and paid before the court order. Though the CS should be accountable to the court order, or may be she is the above the law. Not sure why the Solicitor General is off the hook since he drafter the memo for implementing the court order.

@impunity@Young.. Thank you for seeing this injustice for what it is, Miguna is the only Kenyan with a spine to expose, resist and unapologetically face up to the consequences of his actions. Miguna is a Kenyan like sun rises from east and sets west. Only after he differed with Odinga and was against the handshake did they find this pretense to get him out of the way. Miguna is even very mild in his quest for justice considering what he has gone through. Those who are blaming this giant of Kenya are just like those home guards who fought the maumau but now are celebrating the fruits of the freedom that they did not fight for and at that time the maumau was seen as a terrorist organization.
