High Court Orders Seizure of Sh76 Million Assets Linked to Former Kiambu Governor Waititu
The High Court has ordered the forfeiture of assets worth Sh76.2 million linked to former Kiambu governor Ferdinand Waititu, following a ruling on corruption allegations and unexplained wealth.
The court also directed the recovery of a parcel of land valued at Sh3 million, registered in the name of Waititu’s wife. Justice Nixon Sifuna delivered the decision on Friday, marking a partial victory for the Ethics and Anti-Corruption Commission (EACC), which had sought the recovery of assets totalling Sh1.9 billion.
The court found sufficient grounds for the forfeiture of specific properties, including land and movable assets, which the EACC argued were unlawfully acquired during Waititu’s tenure in office. Justice Sifuna noted that the commission had demonstrated a prima facie case, as the ownership of the identified assets could not be adequately explained.
The absence of credible documentation led the court to classify these properties as "unexplained wealth." As a result, the court ordered that these assets be forfeited to the state.
However, the court rejected the EACC’s bid to forfeit funds held in bank accounts linked to Waititu, his wife, and associated companies. Justice Sifuna said that the commission had not provided sufficient evidence to support claims against these accounts.
Waititu and his wife had contested the suit, asserting that all their assets were lawfully obtained.
