Australia Blocks Many Temporary Visa Holders from Switching to Student Visas

Australia has tightened student visa rules from 2 October 2026, restricting applications from temporary visa holders already in the country and introducing stricter conditions for students seeking to bring family members.
The changes form part of the government’s efforts to control migration and ensure that the student visa programme remains focused on education. They are expected to affect study plans, visa applications and family arrangements for international students and temporary residents.
Under the new rules, most temporary visa holders can no longer apply for a Student visa (subclass 500) while in Australia. Many current international students are also restricted from submitting another student visa application without leaving the country. Those who previously planned to use further studies to extend their stay may now have to return home or travel elsewhere to apply for a new visa.
The restrictions are particularly relevant to holders of Working Holiday Maker visas and Skills in Demand visas, who have previously had opportunities to change their immigration status while remaining in Australia. With this option now limited, applicants may face additional travel costs and a more complicated process when seeking to continue their education.
However, the government has retained exemptions for certain groups. Students sponsored by the Department of Foreign Affairs and Trade or the Department of Defence can continue applying under existing arrangements. Other exemptions cover doctoral candidates, primary and secondary school pupils, students whose education providers cannot deliver their courses, and those who need up to an additional year to complete their studies with the same institution. Students moving from one qualification level to a higher one are also covered by exemptions.
The changes do not affect student visas that have already been granted. Existing visa holders must continue to comply with the conditions attached to their visas. Applications submitted before 2 October 2026 will be assessed under the rules that applied when they were lodged.
Alongside the restrictions on changing visa status, Australia has introduced tighter conditions for international students seeking to bring family members. Students face greater limits on including dependants in both initial and subsequent student visa applications. The changes are intended to reduce the wider migration impact of the student visa programme.
Some groups remain exempt from the stricter family provisions. Doctoral candidates continue to benefit from more favourable arrangements, while exemptions also apply to nationals of Pacific and Association of Southeast Asian Nations (ASEAN) countries, recipients of fully funded foreign government scholarships, and students sponsored by the Department of Foreign Affairs and Trade or the Department of Defence.
For international applicants who do not qualify for these exemptions, the new rules mean that family arrangements will require more careful planning. Applicants may need to make decisions about spouses and children before submitting their visa applications, with fewer opportunities to add dependants after their studies have begun.
