A lawsuit has been filed against Interior Cabinet Secretary Kithure Kindiki by a woman who claims that he has violated her constitutional right to reapply for Kenyan citizenship.
Miriam Otulak claims that her progress in filing the essential applications has suffered undue delays from multiple departments, frustrating her efforts. Seeking redress for the violation of her constitutional rights, Ms Otulak is requesting a statement from the Mombasa High Court condemning the Interior CS's refusal to register her as a Kenyan citizen. Alongside the said officer, the Attorney-General has also been named in the case by the petitioner. Ms Otulak's parentage comprises a Kenyan father from Busia County and a German mother. She says that she was born in Germany.
Although she resides in Diani and possesses a German passport, she contends that the fact that one of her parents is a Kenyan citizen warrants recognition of her Kenyan citizenship. She asserts that her birthright to Kenyan citizenship cannot be nullified or forfeited solely because she has since obtained citizenship from an alternative country, as per the relevant laws.
If a person is born in Kenya and has at least one Kenyan parent, they automatically become a citizen by birth. The first respondent, Interior CS, has been accused of violating Article 16 of the constitution, which states that a citizen by birth cannot lose their citizenship by acquiring another country's citizenship.

Kenya is now visa free marry a foreigner then charge them to get citizenship.This Ruto is surely making Kenya a dumping ground..Is he aware that when some immigrants were offered to be sent to Rwanda from the UK they refused and sued UK immigration.We have enough local problems without inviting foreigners to bring us theirs.
In all practicality, a returning diasporan who's got a bungalow deep in the village, will a chief be bothering you saying your visa has expired now you must leave or renew or reapply citizenship?
I am Kenyan-born and bred and it has proved to be problematic regaining citizenship to a point I don't give a damn anymore about it. I have come to realize that if you do not know anyone at Nyayo House, you might as well forget it. If anyone can travel to around 180 countries visa free, should having a passport with 43 visa free countries be a cause for concern?
