Supreme Court Throws Out Paupers' Petition against President Uhuru's October 26th Victory

A petition seeking to challenge President Uhuru's October 26th victory and filed by two youths has been rejected by the Supreme Court.
The two were seeking to lodge the petition without paying the pre-requisite Sh1.5 million security fee required of anyone filing a petition before the apex court.
Supreme Court Deputy Registrar Daniel Ole Keiuwa said the application by the duo failed to meet the minimum threshold for filing under rule 4 (2) of the Supreme Court presidential Election Petition Rules.
The two, George Bush and John Chengo filed an application known as Forma Pauperis moments to Monday midnight deadline.
A pauper’s brief allows a poor person to present his plea before any court without settling court fees on grounds that they live in poverty.
Meanwhile, another petition challenging the October 26th election was filed by Njonjo Mue and Khelef Khalifa besides that of former Kilome MP Harun Mwau that had been filed earlier.
In their petition, Mue and Khalifa claim that: “IEBC and Wafula Chebukati spectacularly failed to exercise independence while conducting the fresh presidential election.”
Khalifa and Mue filed the petition on behalf of their civil society organisations MUHURI and Kura Yangu Sauti yangu. They seek nullification of Uhuru's victory.
Independent Electoral and Boundaries Commission (IEBC), Chairperson Wafula Chebukati and President Uhuru have been named as 1st, 2nd and 3rd respondents respectively.

The supreme court should find a way to, in effect, throw away all these cases seeking to nullify the oct 26th election.We need very very strict fidelity to the supreme will of the Kenyan Voter.If we fail to have strict fidelity to the will of the Kenyan voter,Then we will be inviting instability(and worse) into Kenya.Therefore the institution of the supreme court of Kenya should seek to rubber stamp the supreme will of the Kenyan voter.Simple.If politicians want to rule Kenya, then they have to get a majority of the votes in elections, as per constitutional provisions.This is the only way that we are going to safeguard the Peace,Stability and Development that we currently have in the country.

Which will of the people? The 30%? What happened to the will of the 70% who protested by not votting? The supreme court are not reading your comments, the supreme court are going to do their job in accordance to the law/evidence.

Even the poor have rights .These judges are just greedy refuse to give the `"paupers" a chance which is false as they would still get paid .All they have to do is seat and listen but then again this are the same people who do not turn up for work even when they are being paid.Only in kenya

The idea that every mwananchi and so called civil (actually evil) society can file a petition in the Supreme Court challenging the election of a president is complete lunacy and a recipe for chaos and anarchy in our country. What happened to the democratic principle that only those who are directly impacted or aggrieved by certain actions of others can file a case in court? Nearly 7.5 million people voted for President Uhuru in the October 26 repeat election. In comparison, how many people does the Muslim group Muhuri, or Sauti Yangu Kura Yangu, or drug kingpin Mwau represent for them to be given an opportunity to overturn the will of millions of voters who exercised their constitutional right to vote? Our problem as a nation are twofold. First, our constitution gives too much powers to bogus organizations which purport to speak or fight for Wananchi when all they are interested in is to line their pockets with blood mo eg from their Western masters. Second, our country has far too many NGOs and evil societies running like headless chickens from o e court to another creating confusion among the masses and worse inhibiting constitutional institutions from effectively performing their work. It's unfathomable that a relatively small country like ours can register more NGOs and evil society organizations than the rest of Africa combined. If any NGO or a real civil society isn't helping to uplift wellbeing of the common Wananchi by engaging in development projects to alleviate poverty and perennial starvation as well as promote health services and education, then they should be deregistered and banned from operating in our country. We don't need a bunch of greedy losers operating as self-elected opposition to duly elected government elected by the Kenyan people.

@Hon Kenjuu.The Jubilee Party should have a longterm project of cutting back the powers of the supreme court.The supreme court should not be able to do what it did after aug 8th.The unjust/uncalled for annulment of presidential elections is a recipe for chaos,anarchy and probably even bloodshed in Kenya.Therefore the Jubilee party should look to use its strength in parliament as well as in the executive, to continue to cut back the powers of the supreme court.

It is called democracy.Everyone who feels that the election was not fair should have the ability to file a petition and deserves a fair hearing which should not be determined by the size of their pockets.Kenyans are indeed asleep there should have been many more pétitions as this forced government needs to get the message that they cannot impose themselves on us and expect absolute loyalty.Only an independent judiciary will save Kenyans lets hoping this time it sends the message loud and clear that sham élections will never be legit no matter the number of supporters or the names they continue to pile on NASA and everyone else who opposes them including civil societies now christened evil societies bacause they are against them
