Tobiko Wants Court to Increase Bail Granted to Billionaire Businessman Jimmy Wanjigi

Director of Public Prosecution (DPP) Keriako Tobiko has asked the court to review the anticipatory bail terms granted to billionaire businessman Jimmy Wanjigi in October.
Through his lawyer and in reference to an affidavit sworn by chief inspector Josphat Gichuki, the DPP argues that the amount of bail granted on Wanjigi is too small compared to the magnitude of the offense he is being investigated against. He wants the bail reviewed upwards.
Tobiko further wants the court to block the billionaire from travelling outside the country without permission from the police and or the court pending completion of investigations. He also wants him directed to surrender more documents before the court as surety that he will avail himself in court until the investigations are concluded.
However, Wanjigi, through lawyer Julie Soweto has opposed the application, terming it as insincere since the police have never grilled Wanjigi or conducted the alleged investigations from the time they raided his residence in Nairobi and vandalized property.
Submitting before Justice Chacha Mwita, Soweto said the police are being mischievous and claim that they are investigating her client in relation to possession of legal firearms was untrue. She further argues that DPP's application is meant to infringe on Wanjigi’s freedom of movement and subject him to oppression.
In October, the court blocked DPP and police from harassing Wanjigi, after it granted him a KSh.50,000 anticipatory bail. The orders have since been extended until further directions by court. The court will rule on the application on 31st January 2018.
