Gov't Fires Back at High Court Ruling Revoking Miguna's Ejection, Says His Deportation Remains

The government has maintained that self-declared National Resistance Movement (NRM) general Miguna Miguna remains deported.
This comes hours after the High Court on Thursday morning declared the revocation of Miguna's Kenyan citizenship as illegal, null and void and ordered Immigration authorities to surrender his passport in court within seven days.
“CS Matiang’i declaration of Miguna Miguna as a foreigner and consequent deportation is declared null and void,” Judge Luka Kimaru ruled.
However, in a statement to newsrooms, Interior Ministry Principal Secretary Karanja Kibicho fired back at judge Kimaru's ruling, stating that the deportation of the firebrand lawyer was carried out legally.
“The government has been made aware of a High Court ruling this morning declaring the deportation of self declared General of the proscribed criminal organisation NRM and who is a Canadian citizen, Mr. Miguna Miguna as being illegal,” the statement reads.
“In as much as the government respects the court’s decision, the government still holds its earlier view that the deportation of Miguna Miguna was done in accordance with the law,” added Dr. Kibicho.
Kibicho further noted that Justice Luka Kimaru’s ruling directing Immigration Director Gordon Kihalangwa to surrender Miguna’s Kenyan passport to the court is “not in the best interests of the country.”
He also said that the state legal team is reviewing Kimaru’s ruling and will appeal the decision in due course.
Miguna was banished to Canada on February 6th, days after he was arrested for his role in the controversial swearing-in of National Super Alliance (Nasa) leader Raila Odinga on January 30th.

The government MUST respect the judiciary .The days of dictatorship are long gone.Today mkebe wa blueband aka Matiangi is pretending he was not aware that Miguna had been summoned to appear in court in person when he signed his deportation order. For National Security reasons, the Government to Kenya must ignore court orders. The leader of a resistance movement cannot be allowed back in the country just because a judge ordered. It is like inviting Joseph Kony back to Uganda as a regular citizen just because a judge may wish to say so. Miguna must remain in Canada until he changes into a normal citizen.

At this Rate we need to get rid of all this judges. Try this non sense in the US and see if you don't mysteriously disappear to abughraib. The safety of citizens must come first. All this judges are compromised and have a price tag to justice. I applaud Uhuru and Ruto and this kind of nonsense must be stopped. It seems that, besides their constitutional duties, these corrupt and ineptly incompetent judges are also making their own laws and implementing such bogus laws. On one account, these misguided judges demand that their frivolous court orders must be obeyed while on the other hand they are impending law enforcement functions of the Executive by their silly poorly thought out rulings and frivolous court orders. Democracy means each of the three arms of government performing its duties and letting the other two perform theirs without interference or undue influence --- then cry foul when the other branches refuse to comply with such interverance. All these political shenanigans our country has been going through can solely be blamed to ill-fated bonehead and insanely senseless decision by corrupt dumb Gang of Four led by Mr & Mrs potato head to nullify the most acclaimed presidential election in Kenya's history. It's political interference, corruption, and sheer incompetence by Maraga and Mwilu judiciary which have created all the political instability we are witnessing in our country. Judiciary must realize that it can push the Executive so far -- the the Executive will ignore the Judiciary and its silly rulings and/or frivolous court orders. The judiciary better realize that I'd doesn't have any means to enforce its silly rulings and/or frivolous court orders without cooperation with the executive. So, let these rogue judges tread very carefully; else if judiciary engages in a protracted war with the executive, it will only be the one to suffer the consequences --- because he who controls the money and security forces has power over the other two arms of government. Remember, we were all created equal, but some are more equal than others!!! The same goes for the 3 arms of a democratic government.

Citizenship is not a privilege but a right. Try doing basic research before commenting. According to the Kenyan constitution if your parents are Kenyan by birth and you are born in Kenya then automatically you are a Kenyan citizen .Miguna is a Kenyan by birth a right that cannot be taken away from him by UK or his muscleman Matiangi aka mkebe wa blue band.Stop confusing it with American citizenship which you apply for after obtaining your green card. That you can loose at any time considering you were not born in the USA .Also citizenship does not vest in the passport thus it was stupid of you confiscating Miguna’s passport thinking you have invalidated his citizenship.Ignorance in and of itself is not a crime however acting out of ignorance especially when you infringe on the rights of another human being is.
