Court Blocks Ruto’s Plan to Build Church at State House

The High Court in Nairobi has temporarily stopped the government from constructing a permanent church at State House or any other State Lodge, pending the determination of a constitutional case.

Justice E.C. Mwita issued the conservatory order on Tuesday, following a petition filed by Transparency International Kenya, the Kenya Human Rights Commission, and two other parties. The petition challenges the planned construction on the grounds that it may violate constitutional provisions on the separation of religion and state.

The petitioners argue that building a religious structure within the official residence of the President could promote religious bias in a setting intended to serve all citizens equally. They maintain that such a move risks undermining the constitutional requirement for state neutrality in religious matters.

In his ruling, Justice Mwita said the case raises serious legal and constitutional issues that warrant further judicial review. “I am satisfied that the application and petition raise fundamental constitutional and legal questions touching on State and religion which require urgent investigation and further consideration by the court,” he said.

The court has directed that all parties be served with the necessary documents immediately. Respondents must file their replies within seven days, after which the petitioners will have an equal period to submit supplementary affidavits and written submissions.

The case will be mentioned on 18 November 2025 for further directions. A penal notice has also been issued, warning that failure to comply with the court’s orders could result in legal consequences.
