Man Wants Supreme Court Registrar Probed Over 'Doctored' Forms that Led to Nullification of Election

A man has filed a complaint before the Ethics and Anti-Corruption Commission (EACC) seeking to have the Registrar of the Supreme Court Esther Nyaiyaki investigated.

The man allege that the Registrar submitted doctored forms before the apex court, which was part of the reasons President Uhuru August 8th victory was declared invalid, null and void.

Rashid Mohammed, who has filed the complaint said that the scrutiny report that was adopted by the majority judges in the Raila Odinga's presidential petition contained opposite findings from Supreme Court judge Njoki Ndung'u's minority one.

"The forms 34B and 34A examined by Justice Ndung’u were certified copies deposited in court by the IEBC within 48 hours of the filing of the petition challenging the presidential election," he says.

Mohammed lodged his complaint through Kioko Kilukumi & Co Advocates and claims that the two opposite findings could not be factual.

"Given the great public interest in the presidential election, the petition that challenged the same and the judgment, it is critical urgent thorough investigations be undertaken," the letter to the commission read.

While reading her dissenting judgment, Justice Ndung’u said she scrutinised all forms 34A and 34B from the 290 constituencies including one from the diaspora and found that the forms were in order and had serial numbers, stamps and signatures yet the registrar’s report had an opposite finding on the same.

We have to fight against this underhanded behavior from the supreme court. What we need at the supreme court of Kenya is righteousness and fidelity to the clear will of the People. Not behavior that appears to the ordinary mwananchi's to be nothing but criminal, unethical and immoral.Kenyan's are right to demand accountability at the supreme court.Kenyans deserve better professional conduct from those that work at the supreme court of Kenya.

Legal criminals must be removed. Legal code of ethics must be followed to the letter. Conspiracy, collusion, and forgery by NASA must be punished. NASA principals and other prime members should must be held individually criminally liable for the losses the country has endured due to their illegal actions.
