President Uhuru Moves Back to Court Over His Nullified Victory

It has emerged that President Uhuru Kenyatta has instructed his lawyers to go move back to the court seeking re-counting of presidential votes cast on August 8th general elections that has since been nullified.

The Standard reports that the president’s legal team will file a judicial review of the Supreme Court’s decision that invalidated his victory.

Uhuru’s legal team is believed to be polishing the new application that could trigger a fresh legal battle with the opposition National Super Alliance (Nasa) in the coming weeks.

Sources said that the decision to move back to court was informed by the Supreme Court’s order that the ballot boxes used in the August 8th election be preserved according to the law.

It is the position of Jubilee Party that the ballots cast on August 8th be re-counted in public.

The new application would come even as the cabinet approved a Sh10 billion budget for a repeat presidential poll, slated for October 26th.

Jubilee Party Vice Chairman David Murathe said the application for judicial review will officially be lodged next week with a view of having ballot boxes opened and votes recounted.

“The first thing I need to tell you is that we are ready, completely ready for a fresh election. But it has become abundantly clear that our competitors are not interested in another election,".

"Because the Supreme Court said the problem was in transmission, we would like the will of the people as expressed in the August 8th election to be validated and there will be no need for a repeat election,” he told The Standard.

On Saturday, National Super Alliance Presidential flag bearer Raila Odinga alleged that President Uhuru was pushing for recount of votes, because they had already stuffed the extra ballots printed by Dubai-based printing firm, Al Ghurair, which he wants blacklisted and barred from printing ballots for the fresh poll.

In my opinion.This is a good move by the Jubilee Party.I think that the Jubilee Party should fight on all fronts. 1)Go to court to push for a recount of the votes. 2)Pass legislation to reduce the powers of the supreme court so that the court will not be able to annul another election in the future based on foolish/boneheaded disregard for the will of the voters. 3) The Jubilee Party should also support the IEBC and Prepare the public for another election on OCT 26th.Which any good Judge of Kenyan Politics knows is going to be won by Jubilee.
The Jubilee Party should use its entire weight and influence to ensure that the will of the people is respected.This legal fight is about PEACE and STABILITY in Kenya.NO reasonable effort should be sparred. Lastly it is my hope that there is actually a Judge in the supreme court that voted in the majority that actually has enough brain material between his/her ears to actually do what is good for the Peace and Stability of the country which is to affirm the majority will of the people.We need for reasonable heads to prevail in Kenya.

@Wambui. I think that nobody really expected the Supreme Court Judges to mess up as badly as they did.I mean this was a really damn and foolish move by the supreme court.I really can't emphasize that enough.But the Jubilee Party has to keep fighting.Because this is really about PEACE and STABILITY in the country.I surely do hope,that those people that have the ears of the supreme court justices in whatever capacity will talk to them and tell them that they just have to AFFIRM the WILL of the People as expressed by the ballots in Kenya.

Good point. I remain apprehensive on finding a judge among the crazy four willing to affirm the will of the pple cos they knew all along what this judgement meant yet did not care. If they care enough about peace and stability then may be. Hopefully they do.

It's ridiculous that jubilee is always reacting to what NASA does ... I bet you .. on Nov 2nd, NASA will start holding demonstrations demanding Uhuru moves out of statehouse and Muturi takes over ... and on Nov 30th, Uhuru will hire 2 lorries and a pick-up and move out ... in the name of obeying the law.. sijui peace and harmony .. mara ni democracy ... what kind of nonsense is this ... screw this damn law and f*ck that constitution ... what we have in Kenya is not democracy .. but demo-crazy ... The last time I heard about the verdict, it said that election is a process and numbers do not matter. Surprisingly this was from the MAJORITY ruling! Is majority not determined by numbers? 4 against 2? why then did the majority count(unless there is a different definition), if the process of arriving at the verdict was flawed as claimed. It makes sense to me to question the verdict process as JP is doing, for if the judicial process was flawed then the majority may not be binding-just like tallied votes did not matter because transmission was flawed.

@OneDay@times you have a good point. Majority of the voters decision was scraped yet the majority of the SC judges decision prevailed. If that is the case then this very decision by the SC shld be challenged since numbers dont seem to count anymore. It is an absurd situation we find ourselves in but we have to fight,it is an uphill battle but Jubilee will prevail.

It's simple divide Kenya n let kisumu pple leave in their county.All of them have/must vacate Nairobi n its environs.Build a wall in the boarder of kisumu n We seal the deal.To enter central Republic of Kenya they will have to pay 50,000 each n cannot stay more than 1 month.No work permits,their planes cannot fly in our sky's.Its Simple they can have have raila ondingasm as their president for life???

@mkenya halisi, if our gukas were that ready to give up, we would still be under colonial rule. Thing is if they can not win they will have to be the subjects and unfortunately get used to it. That said I yearn for the day when Rao and his immediate friends won't be in the ballot because we have very capable Kenyans from all tribes who can lead. Rao is just a thug who should have gone to ICC.

President Uhuru: It is time to go. You remember when you were the finance minister and there a loss of 9 billion shillings? What did you say? Your response was that there was a computer glitch!

During Ndugu Toroitich's government, you were appointed the minister for local government. Then later you served as the minister of finance under Ndugu Mwai Kibaki's government.

After the election of 2007, you served as the deputy prime minister for five years. After the election of 2013, you became the president of Kenya. I have a simple question for you, why do you want five more years? Corruption under your government has reached an all time high. If you combine all the money embezzled during the three previous administration, your short time in office breaks a record.

I remember quite vividly you admitting that you are unable to curb the massive corruption happening during your administration. Don't you think the time has come for you to resign or retire?

Take a look at South Africa. My hero of the African presidency Ndugu Madiba Mandela spent 27 years in jail and when he got a chance to be elected the president of South Africa, served his people for five years and then left somebody else to take over. Your case is similar to Ndugu Raila. he served as a minister, then prime minister. It is time for both of you to retire or resign. We need fresh leaders with fresh ideas who can steer our nation on the right highway devoid of corruption, bribery, and leaders who can think "national" instead of thinking about their ethnic group. We desperately need safety 24/7. We cannot achieve this with your extremely corrupt members of the police force.

The most pressing issue at the moment is to dismantle the corrupt IEBC. This joint cleared more than half of the current elected servants of the people who cannot set a good example for our youth to emulate because of their shady past.

Finally, you need to apologize to the people of Kenya for insulting the judiciary and appearing in public while drunk! In one of the campaign rallies, I saw you with a mug drinking beer publicly. This is very wrong and sets a bad example to the youth.

@Ndikwenda wana. I don't know how much you know about Africa. At the moment, every country in Africa is physically free from any external domination. Let us not forget our lost brothers who were scattered practically all over the world during slavery. Let us not only think about ourselves only.

I would like to see African countries emulate the State of Israel good example of repatriation. Israel gives automatic citizenship to anyone in the world who can show evidence of having Jewish blood in their DNA. I would like the 54 countries in Africa to offer automatic dual citizenship to our brothers and sisters sold in slavery who are ready and willing to settle back in their mother land - Africa. The Africans sold in Arab countries suffer the most. In Iraq, especially in Basra, our African brothers and sisters are still called "shariha"/ "Abid' when translated in English means slave! Let us clean Africa and make Africa Great Again

Let us think beyond Raila - NASA, and Uhuru - Jubilee (temporary political parties) and ask ourselves, what do we want Kenya and Africa to be 50 years from now?

Jubilee is led by a bunch of cowards … raila has set the political agenda in this country for the last 2 yrs … Jubilee is always left reacting and rushing to try look relevant … why was this re-count not demanded during the petition hearing … when orengo demanded to get access to the servers, why didn’t jubilee demand a vote recount … at some point during the petition, it was clear the judges would through out uhuru’s win … why didn’t jubilee demand a vote re-count then ?????? Why now when raila has already said there will be no elections …. Wetangula has said Muturi will be the president on Nov 2nd …. Orengo has described the IEBC as a crime scene that should be sealed off for investigations … NASA has called for demostrations this week … NASA has also demanded that Uhuru should not have political delegations at statehouse …. On Nov 2nd, NASA will be holding demostrations for Uhuru to move our of state house … and I will not be surprised if coward Uhuru hires a few lories to move out his belongings …. Rumour has it that he is now preparing his son Gideon to take over in 2022! The people of Kenya must be vigilant and keep an eye on his role in the current challenging issues that are facing our nation. He has successfully turned Jubilee into the old KANU! As I write now, the governor of Mombasa has been arrested by the police. Uhuru is not a bad person, however, his close proximity with Toroitich is affecting the current events taking place in Kenya.
