Chief Justice David Maraga Defends Kenyan Judges Accused of Receiving Bribes from Akasha Family

Chief Justice David Maraga has come to the defense of judges linked to corrupt deals involving Kenyan drug trafficking family, the Akashas.

Maraga says reports linking Kenyan judges to the Akasha family's illegal business are malicious and meant to tarnish their names and that of the Judiciary.

The Chief Justice has asked Director of Criminal Investigations (DCI) to arrest individuals behind online campaigns “aimed at recklessly besmirching the reputation of officers in the Judiciary”.

“We find the reports unacceptable because they have the potential to demoralise the officers and undermine the administration of justice in the country,” Maraga says in the letter to DCI boss George Kinoti.

Maraga says High Court Justice Chacha Mwita, who is accused of receiving bribes from the Akashas, has never worked in Mombasa or Malindi where their drug smuggling cases were being heard. 

“Even his private practice before he joined the Judiciary never took him to those places. We, therefore, find the link to the Akasha case malicious and obviously intended to intimidate the judge and thus influence his decisions in other cases,” the Chief Justice adds.

He further defends Justice Dora Chepkwony, saying that her role in the Akashas case was very minimal.

“As we have said before, we do not condone corruption but to have our judicial officers recklessly besmirched is unacceptable,” the Chief Justice says.  

The Akasha brothers; Ibrahim and Baktash pleaded guilty to drug trafficking charges at a United States court two weeks ago.

Maraga's naivety never fails to amaze..... almost throwing the country into chaos by his macho attitude.... now,
INFLUENTIAL and CORRUPT people don't have to work in the same jurisdiction/region/area as that of a culprit for them to be BRIBED to help influence judgement -- especially those in the judicial system. For heaven's sake, MARAGA, you sound so out-of-touch for the CJ docket, I'd fire you overnight if I could.

You are placing the blame on the wrong people. The judicial system in Kenya is very corrupted by endemic bribery. Please sir spare us the crocodile tears. The whole system needs a thorough cleanup. All the corruption going on in the country would not be thieving if the system performed properly. Look in the mirror. Thank you FBI and DEA.

With due respect to my learned comrade,Hon.Maraga do you have full report from FBI showing that their list should not included the judges you mention?.
Secondly do you acknowledge that we have some corrupt judges in Kenya?Hold your fire till all the evidence is put forward then let wananchi make their own mind without any judiciary putting a spin on it...

Maraga, you cannot look Kenyans directly in the face and tell us your judicially is not hopelessly corrupt. I thought these Akashas drug cases were making rounds within Kenya's judicial system and you guys couldn't do a thing. You were bribed at every turn until US stepped in to bring long overdue punishment to these drug pushers. You were all owned by Akashas and you know it. Tell us how many big shots in our country are in prison today due to corruption since you took office. Thee that have been apprehend are out there free and busy bribing you guys and destroying any paper traces out there that can help convict them.

It's the FBI that says so. You should go to the US and talk to FBI and show how they are not corrupt. Engaging FBI in the media is not helpful. Asking DCI to arrest anyone is not expected from a chief justice. Where did you study law? A layperson like me knows the correct thing to do is file a court case. Bure kabisa

mshenzi maraga u don't defend anybody until they have gone thru due process.mbona haukudefend the gavanas n mpigs.The Akashas have mentioned the bizness leaders who they r involved in drugs n trust me usa will get them.So maraga b careful to defend anybody unless u have bin bribed??Please usa come for these idiots judges mpigs gavanas so they can go clear their names.Maraga shut up.

Maraga let the due process take its cause. I am sure FBI would not be making slanderous accusations without evidence. Domo kaya tuu. The US is the land of the Law, go after them and stop this Gag orders intimidating people who have a right for speech. You have a corrupt bench Bwana and rather than fight to clean the filth and rot, you have started demo kaya. You may need to start with yourself and your deputy. Born poor in Kenya and soon as you sat on the bench, became billionaires unlike your United States counterparts in same position. Bure kabisa and its a big shame to be the head of a rotten bench. The judge should be asking the DCI to identify those involved. I'm surprised the CJ is not even concerned on the delays of their cases. He thinks that's normal.

He stopped short of defending the Akashas themselves. Note where he says "one of the judges was on the Akasha cases for a very short time therefore he could not have been bribed". What kind of reasoning is this from the country's topmost judge?

Maraga Maraga Maraga. I've never been more dissapointed that with the onset of this latest ravelations. How did we allow these unscrupulous, low-life, dirty, corrupt, murderous Akasha family to drag us to these levels as a country. I remember one particular magistrate (then)
Aggrey Muchelule being dragged in the mud literally by his colleagues in the Judiciary because he wouldn't take bribes from the Akashas nor bend the Kenyan Laws in favor of them. That man went through HELL. This was year ago! Ever since he was taken off that case he's witnessed some sort of reprieve and even managed to become a Judge. Something that was clearly being blocked by the hold down he had on the Akashas. Kenyans including the CJ should know where to place their loyalties. Anyone defending drug dealers and drug barons, then may their offspring or families succumb to Drug Overdose.
