Three Claiming to be Tycoon Jackson Kibor's Children File a Case to Stop His Burial

Three people have filed a suit seeking to stop the burial of Eldoret tycoon Mzee Jackson Kibor.

In a case filed at an Eldoret court, Albert Kibor, Elizabeth Koskei, and Joseph Misoi are demanding to be recognized as children of Mzee Kibor whose burial is slated for Friday.

They want the court to issue them with a temporary injunction to restrain the defendants and other family members from burying Kibor’s remains. The respondents include the youngest wife of the deceased Eunitah Chelimo, Philip Kibor and Richard Sile.

“We are requesting this court to restrain the defendants/respondents either by themselves, their relatives, agents, family members or any other from removing and disposing of the body of Jackson Kiprotich Kibor, pending hearing and determination of the case,” their application reads in part.

The case has been certified as urgent, with Principal Magistrate Naomi Wairimu directing parties to appear before her on April 1st, when the matter will be heard.

The 87-year-old farmer and former politician died on March 16th while undergoing treatment at St. Luke's Hospital in Eldoret, Uasin Gishu County.

Kibor, who was nicknamed the Chairman of the Men's Conference, often grabbed media headlines for divorce cases and endless court and physical fights with his children over his vast property.

In 2017 and 2018, an Eldoret court allowed him to divorce his second and third wives Naomi Jeptoo and Josphine Jepkoech for deserting their matrimonial home and mistreating him. He later married a fourth wife.

In 2020, Kibor won a court battle for a 2,000-acre piece of land against his six sons. Justice Antony Ombwayo ruled that Kibor was the rightful owner of the land located in Soy Constituency and ordered the sons to vacate within 150 days.

The court established the six sons illegally subdivided and processed title deeds to the parcel before selling it to third parties.

In May last year, the former councillor accepted Jesus Christ as his savior and was baptized by retired AIC Bishop Silas Yego. Following his baptism, the octogenarian announced he had finally reconciled with his wives and 26 children after years of disputes and was ready to distribute his estate worth an estimated Sh6 billion.

That would be an abuse of DNA. DNA is only accurate to 99.99%. For Kenya with a population of 50M, if we take 15M to be men of child bearing age, the 0.01% has 150K mean as possible biological fathers. And if we account to nearby Uganda, over 200K biologicals. DNA is not enough, they need other evidence, like hospital and home visits, family gatherings, the type of support that Africans provide to their aging parents, etc. But DNA by itself cannot smoke out the father. It can only suggest.

Kibor is the WSR’s biological father. He also father Oscar Sudi with the other Nilotes Turkana woman. They are both very mean to women and stole a lot.

This law allowing children of deceased to pop up from the blues looking for inheritance money and property is crippling the country and frustrating many families. No one but the owner and legal spouse should have a right to property. If you did not help create it you should not lay claim on it.

I heard through the grapevine that Mzee Kibor sired a very prominent politician in the country and contributed massively towards his campaign funds through the years. Then again, Kenyans are known for uvumi mwingi.

They have a right to figure out who their biological father is or was.
As Comrade MakOnyango will tell you cowboys owner Jerry Jones is in court today for the same.
The issue is not the children, but the ADULTS who consented to have sex.
There are always consequences to our actions.
So, if they happen to be his children, they deserve a piece of his estate.
