Kenyatta-Owned Brookside Files a Defamation Suit Against Nyali MP Mohamed Ali

A milk processing company linked to President Kenyatta’s family has sued Nyali MP Mohamed Ali seeking compensation for alleged economic and commercial harm to its business.

Brookside Dairy Limited accuses the first-time MP of inciting the public against it, citing his remarks on March 3rd at a public rally in Nyeri town where he claimed that the company exploits farmers by buying raw milk for Sh20 and reselling it at Sh120 after processing.

 “Uhuru Kenyatta comes here, he buys milk at Sh20, he goes and boils it and then sells it back to you at Sh120,” Ali was quoted as saying in court papers.

Brookside wants the court to issue a permanent injunction barring MP Ali from advocating public hatred against it and be compelled to respect its rights and reputation and compensate it for the alleged harm and loss he has caused, according to Nation.

“The statement meant that the company exploits the dairy farmers who sell and supply milk to it as raw material for its business. The said statement also meant that the company subjects farmers or suppliers to unfair treatment,” Brookside says in its petition.

“The statement was meant to and did cause economic or commercial harm to the company and its business.” 

The milk processor argues that Ali violated its constitutional right to a good reputation by advocating public hatred against it and vilifying its products.

In an affidavit, Brookside secretary Jacob Ombongi termed the MP’s remarks as false and malicious.

“The actions of the respondent were aimed at turning away or inciting resentment or hatred against the petitioner or its products by consumers of its processed products, its suppliers of raw milk and the public generally,” Ombongi stated.

Every company in kenya and all over the world is in business to make money. You are just leg-agitating Ali’s verbal diarrhea without any solid proof of consumers being exploited.

Can you expound of how this company is exploiting the consumers?

The problem with black Kenyans (generally Africans all over the world) is pure jealousy. You can come up with your own milk products process company to compete with the Kenyatta’s my damn foot.

Jackton, first you cannot be a country’s president with a business conflict of interest. Uhuru is in record as of today as maiming the farming industry in Kenya. First he worked to disable the farming unions. This way he can can get a discretionary benefit by himself. And for a fact that he is not learned, he couldn’t have foreseen it’s outcome. The nation is starting for food today. Perhaps compliment of Uhuru Kenyatta the president together with his virtual deputy president Raila Amolo.

Brookside buys his milk at Sh 20 and sells the same milk to wananchi at Sh120-a whopping increase of 600% - and that doesn't mean anything to you? Wow, let's be careful here @ Mwororo. The farmer owns the cow,feeds it ...etc.That expense comes to xxx amount.If he is accepting to sale the milk at Sh 20,and still be in business, then is some shrewd business man,or outrightly lucky if not stupid.Point being you are not going to sell your product at aloss;belong production cost and expect to be in business.
My opinion is that the MP used hyperbolic language to incite the masses,for whatever reason. Obviously processing milk,packaging,and marketing it is more than ,"just boiling it and selling"
Sure the farmers would like to make good money on their investments,and if they are being exploited why haven't we hard them cry out?This does not mean that they are not being exploited,but I hope the awareness ,and attention this has garnered would make the company alittle more generous.After all they need the farmers.

Farmer has no choice! @Maxiley, Brookside is running a monopoly here, (Ref: Kenya.com Sept 2019). Milk bill:farmer faces criminal charges if he sells milk directly to his neighbors. Cannot sell milk to hawkers. Farmer faces criminal charges if his milk is contaminated with aflatoxins although such may happen because of animal feeds and not the farmer- penalty- Ksh 500K. Buyer can only sell his milk to one processor only- what happened to free market? Brookside can buy milk wherever they want even from Uganda and Tanzania, yet farmer must be dictated where he can sell his milk. What don't you understand here?

Besides, there are other Daily companies which buy the same milk from farmers besides Brookside Dairy in the same locations. These other companies pay way less for a gallon of milk in comparison to Brookside. Toy are just talking from abstracts without the facts.

Jackton, I agree with you that all profit making companies have to make money above their investments. Profit. But then this is a different case. Where a civil servant and in this case the president is running a business is wrong and we all know this is a conflict of interest 101. This lawsuit may just be Brookside's undoing. Exactly what Mr. Ali who looks like he doesn't consume milk since birth has been waiting for. The worst part about this is local farmers are even barred from selling their milk elsewhere because of unscrupulous backlash from the company and it's influence on Kenyan law. At this point the Kenyatta family is the biggest cartel in Kenya
