Sonko Wins Big as Court Unfreezes Sh537m in Assets

Former Nairobi Governor Mike Sonko has regained control of his bank accounts after the Court of Appeal dismissed an application by the Assets Recovery Agency (ARA) to block his access.

In a video from his office, Sonko sang a hymn and spoke of his gratitude, describing the ruling as a miracle after six years of legal proceedings. He quoted Luke 6:38 and acknowledged the support of his lawyer, Harrison Kinyanjui, highlighting his faith and resilience throughout the ordeal. Sonko also referenced both the Bible and the Quran, reflecting his Christian and Muslim heritage.

The appellate court upheld a High Court decision from last October, which found that ARA had not proven the funds in question, estimated at Sh537 million, were proceeds of crime. The judges also awarded costs to Sonko. 

In its ruling, the court noted that the dismissal of a case does not create a positive order that can be stayed, signalling a stricter interpretation of the Proceeds of Crime and Anti-Money Laundering Act and potentially limiting the ability of agencies to extend asset preservation orders once a case fails.

Sonko indicated he would not rush to access the funds, framing the victory as a vindication of his faith.
