The issue of dual citizenship has gained prominence as Kenyans increasingly seek opportunities abroad.
The 2010 Constitution of Kenya addresses this concern, allowing citizens to hold dual nationality, provided that the other country permits it as well. A key requirement for those who obtain dual citizenship is to declare their foreign nationality within three months. Importantly, the Constitution ensures that individuals who are citizens by birth retain their Kenyan citizenship even after acquiring a new nationality.
This provision facilitates smooth international travel, enabling dual citizens to move freely for business, education, or leisure without the encumbrance of visa restrictions. The benefits of dual citizenship extend beyond personal mobility. Dual citizens can engage in business activities and own property in both their countries of citizenship. In Kenya, this translates to unrestricted access to land ownership and business ventures, privileges often denied to non-citizens under Article 65 of the Constitution.
Such access not only promotes personal investment but also contributes to economic growth in Kenya. Tax obligations for dual citizens may also be optimized based on their residency and investment decisions, potentially offering significant economic advantages. Furthermore, the pathway to citizenship extends to family members; the children and dependents of Kenyan citizens may more easily acquire Kenyan nationality, thereby accessing similar rights and benefits.
The journey to obtaining dual citizenship begins with the eCitizen platform, where applicants must fill out a comprehensive application form. This form requires personal information, details regarding the types of citizenship held, and supporting documentation such as Kenyan identification, proof of foreign citizenship, and a birth certificate. Depending on individual circumstances, additional requirements like police clearance may also be necessary.
Once the application is submitted alongside the required fees, applicants receive updates through the eCitizen portal. Approval leads to the coveted status of dual citizenship. It is critical for applicants to adhere to the disclosure requirements following the acquisition of dual citizenship since failing to report foreign nationality within the established timeframe can result in penalties.
