Senator Wants Law Changed to Grant Governors Immunity from Prosecution

Nandi Senator Samson Cherargei has proposed changes to the Constitution to grant governors immunity from prosecution while in office, just like the president.

Senator Cherargei, a lawyer, argues that the move will protect devolution, which he claims is being stifled by the Executive arm of the government. He notes that Kenya should borrow from Nigeria, where governors enjoy immunity from prosecution.

Cherargei, who also chairs Senate’s Legal Affairs and Human Rights Committee, claimed that the charging and barring from office of Governors Mike Sonko (Nairobi), Ferdinand Waititu (Kiambu) and Moses Lenolkulal (Samburu) was part of the Executive’s plot to kill devolution.

“The ruling against the three governors shows devolution is under threat; we have even seen some government operatives addressing governors as provincial commissioners while the courts have issued rulings to appease the Executive.," he said in an interview with Daily Nation.

"The Judiciary is driven by morbid fear because its resources were slashed. That’s why I propose a change to the Constitution to give county chiefs immunity against any form of prosecution."

He further argued that the courts do not have the power to remove elected leaders from office even as he affirmed that he supports the war against corruption.

“According to our Constitution, only the voter has the power to remove a leader from office. It’s not the work of courts, the DCI or DPP, which has become the Directorate of Political Persecution,” he noted.

I would agree with this claim to some extent because a murderer like Obado is walking scot-free. On the other hand, do we watch them as they steal in broad daylight transferring money to their daughters accounts and buy expensive houses while county hospitals are deprived of supplies and workers go without pay?

Creating 47 Governors for a small country like Kenya was a grave mistake. Did you know that Ksh 48.5Billions running the county governments? Billions are spent in car loans and house mortgages for our so Called county leaders. Add that to their salaries and perks and sitting allowances. You get the picture? And don't forget to add up the millions lost in rooting and corruption.
Note, USA with a population of more than 320 million people have 50 Governors only. We have 47 governors yet our country is the size of Texas. We need to significantly reduce the number of counties in Kenya for effective utilization of country resource and maximize use of natural resources to assist all Kenyans. The devolution we are running now is pure madness and oppression for the masses.

I agree with you on this, the country should have been left the way it was with provincial commission performing the roles now performed by the county Governor. 47 Counties is a very expensive way to manage a country, the size of ours.

Is it strange that a TangaTanga from DP Mugotio home would recommend such lunacy? No one is above the law. Laws must not be changed so that Ruto can establish a new source of county money to donate to corrupt church leaders. Only shi-hole leaders like kubafu Cherargei would support such madness! Do you guys care about the people who are denied services by corrupt leaders? Kick them out whenever they are found. Corruption should be nabbed from the root. Cherargei, as buffoon as he maybe is just a mouth piece for Ruto, just like Murkomen is a goon for hire to dispel rumors, innuendos and gossip.

Anything they vomit is a suggestion by the newly decorated PhD Man in corruption philanthropy. The high priest of corruption is now asking a Maasai to lie about 3,000,000 eggs that never were to cover up 21 billion shillings stolen from women and children. I think he either has a benefactor who is a governor or is planning to run for governor. If this license to steal law passes he or his benefactor are then free to steal without fear of doing a perp walk. Kenya needs to revisit tue constitution and reduce the number of governors to 8, have a lieutenant governor elected on their own merits, a recall provision and drastically reduce the governors powers
