Ruto's Lawyer Kithure Kindiki Likens Bomas Chaos to the US Capitol Attack

President-elect William Ruto’s lawyer Kithure Kindiki has described the events and chaos witnessed at the national tallying centre in Bomas of Kenya on August 15th as an attempted but failed coup d’état.

Making his submissions before the Supreme Court on Thursday, Kindiki claimed that the events were well-choreographed by agents and supporters of the first petitioner Azimio presidential candidate Raila Odinga in order to stop the IEBC Chairperson Wafula Chebukati from announcing the results of the presidential election.

“The said activities at the national tallying center amount to an attempt to overthrow the constitution of Kenya and subvert the sovereign will of the people of Kenya. It is our view that those events alone constitute an attempt to establish a government unconstitutionally, and those events are basically an attempted but failed coup d’état,” he submitted.

The attorney likened the mayhem witnessed at the Bomas of Kenya to the January 6th US Capitol attack when former president Donald Trump lost the election and his supporters stormed Capitol Hill.

“On 15th August 2022, a mob of people invaded the dais of the national tallying center. Chaos erupted and several IEBC commissioners and staff were seriously injured but to date, no one has been asked to write a statement,” Kindiki stated.

“Those events and activities amount to nothing short of a fragrant attempt to overthrow the constitution of our country, to subvert the sovereign will of the people of Kenya contrary to Article 1 of the constitution.”

“This court should stop Barabas from benefitting from his malfeasance.”

He told the court that Ruto was validly elected as the fifth president of Kenya, following tallying, verification and declaration of results by the electoral commission.

“The tallying was done in the presence of all agents. No one should be declared winners of an election they did not win,” he added.

If that is a "crown" that shows how learned one is, I dont want it.Law society of Kenya should be ashamed for keeping quiet on this matter. To me it appears that if mzungu were to start wearing green shoes as a sign of supreme legal mind, these africans would gladly ape him...When are we going to decolonize our minds?It's past time we realized that aping mzungu makes us look inferior.

About ten year ago, I wrote an letter to the editor of Standard on this issues- and it was published. At that time,some Mpigs had attacked Koigi wa Mwere for wearing african regalia in parliament. In the letter, I had mentioned how our brothers in West African proudly display their west african regalia at the UN,while Kenyans were"throttling" themselves with ties,and acting "white".

What happened at Bomas was an attack on democracy. The only difference with the Jan 6 attack on US capital is that in the US, the attackers were held accountable to their actions, while in Kenya, no one was held accountable.

I seriously challenge the so called "educated men and women" of our continent to come up with a better political system that is not based on the old-fashioned and hackneyed lexical item globally known as "democracy."
The system based on “democracy” benefits the "majority" at the expense of the “minority.” In addition, it benefits the “strong” against the “weak.”
It's time that a better political system is developed that does not favor the majority or the strong but accommodates both.
