Court Rules MP Babu Owino Has a Case to Answer Over DJ Evolve Shooting

A Nairobi court has ruled that Embakasi East MP Babu Owino has a case to answer over the shooting of Felix Orinda, alias DJ Evolve, in 2020.

Milimani Senior Principal Magistrate Bernard Ochoi ruled that the prosecution adduced evidence to warrant putting Owino on his defense.

The accused is charged with disorderly behavior while carrying a gun by firing one bullet with intent to shoot DJ Evolve at B-Club in Kilimani, Nairobi on the night of January 17th, 2020.

The hearing is scheduled to start on June 15th.

In 2021, the trial court granted an application by DJ Evolve to withdraw the attempted murder charge against Owino but upheld the prosecution's objection that the second count on misuse of a firearm could not be withdrawn at the request of the victim.

DJ Evolve withdrew the matter following an out-of-court settlement where the MP agreed to buy the victim an apartment, a customized car designed for use by a person with a disability, and pay his medical bills and other expenses.

 “As a condition of withdrawal, the MP will purchase an apartment for the victim which will resolve the issue of house rent, and also continue paying for the hospital bills of the victim who comes from a humble background,” Magistrate Ochoi said in the acquittal ruling.

In addition, Owino agreed to set up a music academy for DJ Evolve when he recovers and use it to generate an income.

Following the shooting, the disk jockey was admitted to Nairobi Hospital for six months where he underwent multiple surgeries before he was discharged to recuperate at home.

Way to go, justice now in the offing. A criminal will always be a criminal whichever direction he/she takes, irrespective of his/her status in the society. And this criminal is lucky to have done that in the most corrupt country in the world: creamed with impunity. Next should be MP Ngunjiri, Obado Kabado, Raila, Uhuru, Ruto, Cherangei, etc.
These some of the charges Owino could have been charged with in America:
1. Misuse of a registered firearm.
2. Improper use of a registered firearm.
3. First degree attempted murder.
4. Second degree murder.
5. Use of firearm with intent to harm unarmed male.
6. Premeditated murder.
7. Third degree manslaughter.
8. Creating disturbance and in a peaceful environment.
9. Discharging a registered firearm with an intent to cause grievious bodily harm to an innocent peace-loving citizen.
10. Using high ranking public offices(Uhuru and Raila) to cover up and protect a suspected criminal.
11. Misuse of your position in a public servant to silence a victim with use resources suspected to be stolen from public coffers.
12. Misuse of a registered weapon to intimidate, threaten and harm, with others not in court, an peace-loving citizen.

Good! Babu Owino must answer for his past inappropriate deeds. But Owino is not alone!
What about those responsible for:
1. The Kiambaa Church Holocaust in Eldoret in 2007?
2. Killing Chris Msando?
3. The death of Meshack Yebei?
4. The death of Jacob Juma?
5. Stealing Muteshi's land?

N.B. Until those responsible for roasting and killing 30 innocent people in a place of worship (Kiambaa church in Eldoret in 2007) are brought to justice, the Kenya Judiciary will not be judged as a fair and objective institution in the eyes of ordinary Kenyans.

Can any YES voter including prosecutors Wako and Tobiko explain the way forward if Orina succumbs from injuries coursed by Ongili’s shooting?How can attempted murder charge be bargained?Will murderer Kimani Ngunjiri also buy rental houses to his victims?Haji must issue licenses to kill to three to five other Kenyans to stop these senseless gangsters from shooting other Kenyans in ADVANCE.

The burger should be cooling his heels at Kamiti maximum.
Also only in Kenya where the culprit can be forgiven by the victim. Charges should always be so and so vs the state.
