IEBC Declines to Revoke Sakaja’s Clearance to Vie for Nairobi Governor

Independent Electoral and Boundaries Commission (IEBC) has declined to revoke the clearance of Nairobi Senator Johnson Sakaja to vie for the capital’s governor seat in the August 9th general election.

IEBC Chairperson Wafula Chebukati says the electoral commission cannot revoke the clearance despite the Commission for University Education (CUE) withdrawing the recognition of Sakaja’s Bachelor of Science in Management degree from Team University in Uganda.

Chebukati indicated that the degree issue was settled by the IEBC disputes resolution tribunal that cleared him, and the only way the commission can reverse its decision to clear Sakaja to contest for the Nairobi gubernatorial seat is through a court order.

“The only way to compel the commission to revoke and/or reverse its decision is through a court order setting aside the decision by the tribunal,” Chebukati said in a letter to CUE.

Sakaja was cleared to vie for the seat on June 19th after a petition filed by Dennis Wahome was dismissed by the tribunal, which ruled that it lacks the jurisdiction to investigate and ascertain the validity of Sakaja’s degree.

Wahome, who was dissatisfied with the tribunal’s decision, went to the High Court arguing that Sakaja has no academic qualifications to vie as Nairobi’s governor.

On Friday, the High Court declined to stop the IEBC from including Sakaja on the ballot for the Nairobi governor race. Justice Anthony Mrima instead ruled that a case filed by Wahome be heard on July 4th.

IEBC's position is not in good faith. The position that the courts have to issue orders to compel the electoral body to revoke Sakaja's clearance is pedantic. Sakaja does not hold a valid degree. Degrees are conferred by universities accredited to do so. Submitting a valid degree certificate is a simple straightforward matter. No amount of polemics and subterfuge will change neither the degree requirements nor Sakaja's educational qualifications.

Ndugu Wafula Chebukati ameshindwa kufanya kazi yake ipasavyo.
Yafaa astafishwe kazi mara moja hasa kwa manufaa ya umma.

Does Chebukati look like an intelligent guy to you? He is just a dummy that can’t figure or understand what the law says. This guy will bungle the elections come 9 August 2022. Just watch this space.

Sakaja the new governor. However I don't like his lies and inability to finish his degree from wherever. Stupidity of relying on big men to cover you is over. Chebukati goofy great for politicians

How Independent is IEBC? What will the courts do anyway, but affirm requirements,or there lack of.One of the requirements is that a candidate vying for governorship should have a college degree from a credited institution.
Today barely amonth to the election day,we should not be dealing with issues of who is a bonafide candidate. All candidates should have been cleared by now. This is a mess.Elections come every 5 years.Surely this is enough time to lay requirements, and policies in place. Not to mention, ample time to correct irregularities that might have mired the previous election.

Your Luhya boy can’t even take charge and responsibility. I hope @maxiley is not as indecisive as your home boy Chebby. I really do not know who put Chebukati at IEBC. He will mess everything come August 2022.

Chebukati took the bribe he knows by the time this case gets litigated in court the elections will be over considering they are next month.Amesha tumia hizo pesa na harudishi shauri yenu endeleeni kupayuka yeye alijipanga kitambo msimuletee kelele nyingi amesha amua hivyo ndivyo kulivyo kwani mtadoo🤢

Chebukati is walking within his line. Constitutionally his mandate does not include investigations into college degree credentials.
Perhaps on a similar note he doesn’t want to open a can of worms. Raila is said to have a questionable degree too. And there lies the bone of contention.
If it’s good for goose it’s as well good for gander.
