Why Babu Owino Could Lose His Embakasi East MP Seat Next Week

Embakasi East Member of Parliament Paul Ongili alias Babu Owino will know whether he will lose his seat or not on Wednesday next week, when the High Court is expected to deliver a ruling on whether to quash the newly elected MP's response to a case challenging his August 8th victory.

Francis Mureithi, who contested for the seat on a Jubilee ticket and filed a petition challenging Owino’s win, said the respondent violated the law for filing a response to his after 12 days instead of required seven after the petition was lodged.

Through his lawyer Ham Lang’at, Mureithi says that the former Students Organization of Nairobi University (SONU) chairman failed to provided a substantive reason as to why he filed his response outside the required timeline.

In an affidavit, Babu said that the petition by Muriithi was served through a publication in a local newspaper, which he learnt of it later and thats why his response was delayed, an argument the petitioner has dismissed as ‘unreasonable’.

“The respondent is responsible for own delay. It is negligence for an MP to allege he didn’t see an advert in a widely circulated daily,” said Langat.

Babu’s lawyers Jackson Awele and Edwin Sifuna said that their delayed response should even be commended as they were not officially served with the petition.

“It’s our submission that the late filing can’t prejudice the petition as our action is reasonable and have strong basis,” submitted Counsel Jackson Awele.

@Mugi. Thank you for your comments. I am always open to constructive criticisms as long as insults and name calling are not part of the criticisms.

To be objective Ndugu Mugi (the wise one), the IEBC totally messed up the previous elections. the best solution is to disband it and get new and responsible people to run the election again. I know, the cost to the innocent voters of Kenya to run another election is unwarranted and a loss of public money! But for goodness sake, IEBC should have left their offices a long time ago.

This joint (IEBC) shows to the rest of the world how incompetence is rewarded in Africa! Just see the candidates that they cleared to run! You are right. b

Guys Babu owino is has never still an public funds like Anne Waiguru who stole millions of millions from NYS. This is,serious crime and in a developed vibrant Democratic countries with strong judicial institution Ann Waiguru would have not been allowed to run for officr.Her ass would in jail I mean federal prison but because the president is agikuyu she is still enjoying the money she stole in sacks.

The boy had legitimate reason not to respond on time because he learned of the petition through a local publication. It was supposed to be served to him in person or through a registered mail or in a hand delivery. Publication is not a P.O. BOX. I think it will be extremely unfair to deprive him his parliamentary seat based on that technicality. Democracy does not mean witch-hunting or taking advantage of a situation!!!. The boy will still go to jail but not because of this petition. He will go to Jail because of his aggressive tendencies of violently attacking people unprovoked. We saw him attack his fellow parliamentarian without been provoked. The corridors of the Kenyan parliament has no room for those that want use muscles instead of brains.

The MP has a point, and will possibly win, but the court decision will be a step backward. The process of serving a defendant via widely read publications was included to address problems with personal service to the head of state (remember Moi and Matiba (1992), and 5 yrs later with Kibaki). The MP's win will mean end to service via newspapers, since the accused can opt not to read. Its back to personal service, unless the parliament act.
