Chief Justice David Maraga Reacts to being Branded the High Priest of Corruption

Chief Justice David Maraga claims that there is a scheme by powerful individuals to taint the image of the Judiciary.

Maraga says the group of individuals, who have lost cases in court, have embarked on a smear campaign aimed at painting the Judiciary as corrupt. 

While admitting that there are corrupt judicial officers, Maraga argues that every institution will always have some black sheep.

"Corruption is all over the country; we have sacked quite a number of judicial officers. We are not hiding them. If they are caught doing anything wrong, they must be punished. But I will defend them if they are just being vilified by people whom they have made rulings against,” he says.

The CJ further claims that the persons are behind an online campaign meant to portray him as the high priest of corruption.

“We know who is behind them…we will defend where we are unfairly criticized,” says the Chief Justice.

“Instead of praising us for restructuring ourselves to serve wananchi better, they are attacking us. We have only reviewed our structures to facilitate greater efficiency in the delivery of services to the people."

“If by doing the right thing this is what I become, (the high priest of corruption) so be it," adds Maraga.

Finally he owned up. Corrupt
judiciary led by him is a real sorry state of our country. What to do about it is the next question.

@Godhavemercy, next question is for him to go back to mashambani cos he is an embarrassment to the CJ position. He is definitely NOT on the same page with Kenyans when it comes to fighting corruption. He is a short sighted wanna-be politician who should never have been a judge to begin with. Very defensive and can not take challenges without thinking he is being attacked. Bure Bure Kabisa.

Why hasn’t any case brought to you been successfully adjudiced? Why do we keep seeing catch, remand and release then cases go into bottomless pits and nobody ever goes to to jail despite all the evidence about corruption? Is it because none of all these cases were actual crimes? Really, none of them? Come on Mr. Chief Justice if you are fearless as you claim then prosecute these corrupt politicians and send them to jail and don’t accept fines because someone paying fine with stolen money is not justice. Just like giving contributions on using stolen money is not philanthropy. Why does the judiciary allow people to use loopholes to escape justice using stolen money? For an effective judiciary to work people need to see results of the process not just cases constantantly being thrown away ati because of lack of evidence.

If the arresting and investigative agencies can not come up with a strong case the judiciary can do nothing about it other than release.

Do not be fooled by the boy in statehouse who is always blaming the judiciary for the failures of the agencies he has control over. Why Wabukala is still at EACC is nothing short of amazing. He should have been replaced a long time back.

There's lots of blame to go around. However, Maraga is more interested in asserting the independence of the Judiciary rather than sinking his teeth more intensely into the plague that is sinking Kenya into a laughing stock when it comes to legal recourse. Look at the reprieve and lenient bond terms given to those who have been involved in the most heinous crimes costing lives and taxpayers billions. In the least, according to the DPP, the accused shouldn't be on any government payroll.

CJ seems to blame the victims of the system. Since time immemorial people have lost cases in courts, accepted it and moved on without invoking corruption. It is worrying when leaders are not objectively taking constructive criticism and instead they pass the blame or downplay the corruption plague. Days ago Uhuru was quoted as saying "Mimi sitaki vita na mtu yeyote ...." The hands-off leadership style of "see no evil hear no evil and speak no evil" will only be emboldening the corruption cartels. Corruption is rich, wealthy and elitist, give it an inch and it takes a mile fighting back. Radical surgery, with laser beam precision, flick-of-a-switch speed, grip of a vice and swing of a sledgehammer is what is needed to stem the institutional corruption.
