Why Miguna Miguna Was Blocked from Flying to Kenya: Gov't Spokesman Oguna

Government spokesman Col. Cyrus Oguna has explained why Lufthansa Air and Air France barred deported lawyer Miguna Miguna from flying to Kenya.

Oguna on Wednesday the reason why Miguna faces hurdles in his effort to travel to Kenya is because he is listed as an unruly passenger in accordance with international aviation standards. While distancing the government from Miguna’s woes, Oguna indicated that Miguna is free to travel back to Kenya but must first acquire the necessary travel documents. 

“… according to International Civil Authority Organization (ICAO), a passenger must have valid travel documents. Dr, Miguna is free to present himself to any Kenyan Mission to obtain his passport,” said the government.

“It is, however, puzzling that Dr. Miguna has not made an effort to obtain his passport from any of the missions. Nevertheless, our missions abroad are ready and willing to assist him to get his documents once he presents himself.”

He noted that Miguna was categorized as an unruly passenger following a March 2018 incident where he caused a scene at Jomo Kenyatta International Airport (JKIA) in Nairobi and was forcefully ejected from the country.

“As a government, we wish to clarify that following the incident at JKIA in March 2018, Dr. Miguna was categorized as an unruly passenger in line with Annex 17 of International Civil Authority Organization (ICAO) standards and recommended practices that allow the prohibition of unruly passengers,” Oguna said in a press statement on Wednesday.

He added that Miguna’s theatrics are a threat to the category A1 status awarded to JKIA in 2017 and which allowed for direct flights between the US and Nairobi.

“His unruly behavior was seen to have the potential of threatening category A1 status of JKIA which took the country a lot of effort and work to achieve. This category certifies that we have put in place all the necessary safety and security measures in all our airports. This is an accomplishment that we are committed to jealously protect,” added Oguna.

That's a liar (Dr Miguna categorize as an unruly passenger) from the government, but he traveled from Canada thru European territories without any problem. The government should be straight forward about this.

This man used his Canadian passport to travel to Europe, however his travel segment to Kenya...he failed to acquire the required docs hence refusal to board that flight. When you tout this false info....when a Kenyan has a visa to The EU...does this mean he can be allowed to Board a flight Stateside or Canada..the answer is NO! So this Miguna should simply comply with entry requirements of any country including Kenya. And anyway...acting in this manner which creates unrest in a country even homeland...should give any Kenyan including the govt the right to bar entry. He can go cause unrest elsewhere..or back in Canada.

Kenyans...wacha siasa za Miguna. He is as stale as last year's chinese noodles.

As unlikable as Miguna is, every Kenyan of sound mind should be concerned that a fellow Kenyan is being treated as such. It is him today tomorrow it will be you. No one is more Kenyan than the other. We are all the same, with equal rights having been born on the Kenyan soil. They are attempting to silence him now but in doing so they are making him larger than life. They are afraid of him because they know Kenya is tilting towards a revolution. A revolution will still happen.#wajinganyinyi!

@Mugikuyu, you will be treated the same if you go to JKIA and give your Id instead of passport. If you copy and paste what Miguna is doing that is what you will get. So many diasporas go to Kenya and come back without any drama. He is not special. He should follow the rules that everybody else follows. He deserves what he is getting.

Kenya, I have been treated with nothing but respect by JKIA immigration officials over the years. They have gone out of their way to be helpful with any hiccups I may have....most recently, I forgot to carry the required $50 dollars visa few and they worked with for alternatives - no bribes. Miguna on the other hand believes document submission does not apply to him. I am not surprised by the treatment he's getting. He denounced his citizenship long ago and like any other diasporan, he needs to reapply for reinstatement. Period.

Miguna should follow the law as stipulated in the constitution of Kenya pertaining to regaining the Kenyan citizenship like any other Kenyan who denounced their motherland citizenship. Kenya government should not bend for Miguna Miguna. He is a lawyer and knows it better. A lot of Kenyans are right now going through the process of regaining the Kenyan citizenship, and Miguna is no exceptional.

Good people, I feel deeply for Miguna's situation, but I also understand it. Kenyan Law applies within the borders of Kenya, and an International Airport, such as JKIA, although physically in Kenya, is under International Jurisdiction. No arm of the Kenyan Government, whether Executive (read President), or Judiciary (read Judges), can purport to issue 'Orders' on what goes on there, because what goes on there is not Subject to the Constitution of Kenya, but the Laws made by global bodies that regulate International travel. If they say that one has to have a passport, a Kenyan Judge has no Jurisdiction to alter this requirement for one passenger, and say that he can be allowed to use his ID to enter Kenya. The laws created by these Bodies apply to all Travelers, Airlines, and Airports where they land. It does not matter why he doesn't have a passport. He cannot travel without one. It is this global bodies that blacklisted Miguna because of his behavior, not the GoK. Mark you all the blame directed at the Government is coming from Miguna himself, and has not been independently coraborated. Miguna was traveling on Canadian passport, and he can use it to enter Kenya, whether or not he is a Kenyan citizen. The Airlines just don't want the drama that accompanies him, and Kenyans cannot force them to accept it.

My advice to him is: KQ flies directly from North America and Europe, to Kenya. He should look for a connecting flight to Kenya with KQ. I am sure he will be allowed to board the flight.

The court asked the government to allow him in the country.So which laws are you talking about?
Who doesn't know the illegitimate govt is trying to silence him by frustrating his move be back to Kenya.
MM has never denounced his Kenyan citizenship.Check your records before making wild allegations.When MM was in Kenya he was using Kenyan passport even when he was working with ODM.
Some busy bodies are making unfounded comments here.

@ Settled Nomad , Miguna ×2 does not appear to be a good listener and will likely not heed your words. His diehard supporters fail to acknowledge that he refuses to take the simple steps those of us who lost our citizenship before 2010 took. It is puzzling why he is so hard headed. I find GoK to be irredeemably corrupt but it was Kenyans who passed the constitution as it stands and if he wishes to be recognized as a leader, albeit one who is loud, self absorbed and obnoxious, he can't pick and choose the parts he complies with.
