Lab Test Adds Twist in MP Gideon Mwitis Rape Case
The case in which Imenti Central MP Gideon Mwiti is accused of raping a woman has taken a new twist after two independent medical reports indicated there was no evidence of sexual contacts between him and the accuser.
Both the DNA report from the Government Chemist and a separate report from the Nairobi Womens Hospital, where the woman alleged to have been raped by the MP was hospitalised for treatment, have indicated there was no evidence of sexual intercourse from tests conducted.
The two reports are already before courts, having been served to both the prosecution and the defence in the trial of Mwiti (pictured), who is facing rape charges before a Nairobi court.
The MP was charged that on March 21, 2015 at Tana club in Westlands, he raped a married woman and intimidated her.
An analysis from samples to determine the presence of semen, spermatozoa, blood, hair or fibre produced negative results in all the 18 items taken for check by the CID at the Government Chemist.
A report from the Nairobi Womens Hospital on the tests on urine and the High Vaginal Swabs Microscopy, prepared by a Laboratory Technologist Benson Mwangi, indicated there was no evidence of spermatozoa from the blood and urine samples from the complainant.
The tests are indicated to have been conducted on March 24 at the request of a Dr Muhindi, two days after the alleged rape and a day after the victims admission at the Hospitals Hurlingham unit.
Separately, according to the DNA report prepared by a Government Analyst Anne Wangechi Nderitu at the Government Chemist Department, the high vaginal swabs collected from the woman had neither seminal stains or spermatozoa, the common element of sexual intercourse.
A total of 18 items had been taken to the Government Chemist by CID officer Lucy Mbithe for analysis in the rape investigations. "It was desired to examine the items listed above and determine the presence and source of semen, spermatozoa, blood hair or fibre," states Ms Nderitu in her report.
She adds: "The pant (item 3) and garment (item 4) were not stained with blood, semen or spermatozoa".
Similar findings were given in respect to three other items that had been received for analysis from the CID, with also no evidence of blood, fibre of hair on the garments taken by police from the MP. Nail clippings from the complainant also did not give any incriminating evidence
The DNA profiles generated at the Government Chemist in respect to buccal swab samples taken from both the MP and his accuser gave results that did not match.

We have become a society of crucifying and passing judgments to people before proven guilty by the court of law. This makes it hard when the outcomes of an investigation don't favor the victim. If the women hospital where she was taken come out with a negative result, what else do we expect? Who knows who is telling the truth anymore? Only those who were present can tell with 100% certainly, what happened on the material day. And that is Mwiti,and the married woman. One of them is not telling the truth.Now the question is who?
It is easy to sympathize with the "victim "and vilify Mwiti,but in the wake of these two independent labs. essentially exonerating Mwiti,shouldnt we as well do same? He may have dogged the bullet,we dont know.
And yes evidence do disappear from time to time especially in a corrupt country.But is this what happened? We dont know.
Certainly something happened to that married woman.Iam not sure what,but whatever it is,was not consensual,so it seems .But why would she subject herself to the rape test knowing well that spermatozoa would not be found?Unless she had no inking as to what the test entails.

If my wife or any of my daughters were violated by any man, irrespective of his status in society, I assure you I'll go for his neck, period! If they arrest me and punish me for my application of the rule of the jungle, so be it. It'll be worthwhile to suffer that way for the dignity of your loved ones. You don't hear anyone condemning all Luos because Raila and his fellow Luo thugs led the 1982 coup d'état which turned Moi into a tyranny who killed and destroyed many lives; or for Raila's ringleader role in the 2007/08 atrocities which almost plunged our country into an endless civil war. So, learn to think before you puke your hateful nonsense on this or any other blog. Having said that, I totally agree with the comment that in Kenya money buys everything, including desired DNA results. I also agree with Mugane's question - if Mwiti didn't do something grossly wrong, why was he pressuring the woman's husband to settle out of court? Another important question to ask is, if the woman wasn't raped and severely traumatized, then why did the Women's Hospital admit her - just to get money from her? Who really knows whether the 18 items tested came from the victim or another woman; or whether the items were substituted before they were given to the Government Chemist and the Women's Hospital? After all, the items were tested (and presumably delivered) two days after the alleged rape! Whether the tests were negative or not, the criminal case against this alleged rapist must go on because the taxi driver provided information on physical and emotional condition of the victim that night which clearly incriminated Mwiti. This shameless and demented MPig should never be allowed to get away with the heinous crime he committed to the victim that night - whether it was attempted rape or actual rape now being covered by bogus DNA results.

The case reminded me of how Kamangu was killed so that his wife,Wanjiru-the witch could be married to a Majete from South Africa.Wanjiru bribed the pathologists with shs 400000 each and they "CONCLUDED THAT KAMANGU WAS KILLED BY CHANGAA" but Majete ran away when Wanjiru told him that she has got rid of Kamangu.BRUTAL REVENGE IS THE ONLY WAY TO SETTLE THIS CASE.
