High Court Justice Odunga Convicts Matiang'i, Boinnet for Defying Orders to Release Miguna Miguna

The High Court on Wednesday convicted Interior Cabinet Secretary Fred Mating’i, Inspector General of Police Joseph Boinnet and Immigration Principal Secretary Gordon Kihalangwa for contempt of court and will be sentenced on Thursday.
Justice George Odunga ruled that the three top government officers were guilty for contempt of several court orders in regard to the detention of embattled self-declared National Resistance Movement (NRM) general Miguna Miguna.
Justice Odunga further directed the three to appear in court on Thursday at 10am for their sentencing, failure to which he will read the sentence in their absence.
“If the respondents will not appear in person before me tomorrow, I will proceed to sentence them in their absence,”ruled Odunga.
"It is time for those who violate the constitution to take responsibility for their own actions. Court orders must be respected and obeyed whether one agrees with them or not. This court must not make orders in vain otherwise it will be subject to ridicule."
"This court gave the three officers an opportunity to defend themselves by directing them to appear in court but they decided to go into hiding instead," Odunga said in his ruling.
The judge also ordered that Miguna, who is being detained at the Jomo Kenyatta International Airport, be released unconditionally.
Justice Odunga had earlier in the day summoned the trio to appear before him in person, but they failed to obey, saying they were engaged with other matters.
The three have disregarded orders to free Miguna issued by Justice Roselyn Aburili on Tuesday and another by Odunga on Wednesday morning.
Contempt of court attracts a penalty of at least six months in jail.

The Miguna is in clear violation of IATA and Immigration laws. Odinga who do you think you are? You sure belong in some place worse than a graveyard. If Miguna is not a Citizen of Kenya, he should be produced in court.
If Miguna is a Canadian who entered Kenya without a passport he should be produced in court.
If Miguna is refusing to cooperate with immigration department on his citizenship status he should be taken to court.
Now that Miguna does not have a Kenyan nor a Canadian passport, he can't be deported anywhere because he can't be identified, he should be arraigned in court.
If you have any respect for court orders, Miguna must be produced in court.
If Miguna is a criminal and he is in Kenya illegally, he must be taken to court.
If Miguna was disorderly and caused chaos at the airport and therefore disturbing peace, he must be taken to court.
If Miguna is a threat to peace, security and stability in Kenya, such a person must be taken to court.
Whatever you do or Miguna doesn't do, the only right thing is to take him to court.
Justice Odunga is waiting for him there.

Gvt cannot waste resources deploying tyranny of military at an international airport just because of Mr. Hon Miguna what a shame. Worse still try to force him to a flight to Dubai who is going to pay for all those flight delays connections it looked like GVT was oeperating in the 16th century.

@Guest 3. Odunga is waiting for what? Odunga is deplorable and a disgrace for some of us that practice law. We adjudicate cases based on Case laws. Some laws apply to the international standards in which Odunga perhaps skipped the classes. How can he be allowed entry to go to the court ? has he met merits for entry? Anyway this will bring strive with IATA. We should all go entry points and bring miguna tantrums demanding to go to court. Try that Miguna stunt when you travel to US or Europe and see what happens... I beg try it next time you travel and you can text us later and tell us Odunga was right... Upuuuuuuus

But the President has the Pardon authority, and can do it within minutes of sentencing. Would be much better if the Judges can get involved and address the process of getting Miguna into the Country, instead of giving orders from the bench. The process of court sentencing, and President pardoning leaves Miguna at the airport, and its all legal.
