Chief Justice David Maraga has blasted President Kenyatta for disregarding court orders and curtailing the operations of the Judiciary.
Maraga in an explosive media briefing on Monday blamed Uhuru for the huge backlog of cases citing his refusal to appoint the 41 judges recommended by the Judicial Service Commission (JSC).
Maraga further called out Uhuru for disobeying two court orders, accusing him of violating the Constitution by refusing to appoint judges.
“It is important to clearly and categorically state that this shortage of judges and the near paralysis of court operations has been caused by the President.”
“The President has persisted in his refusal despite orders in two cases requiring him to swear in those judges within 14 days,” a seemingly enraged Maraga noted.
He gave the Environment and Land Court as an example, saying the unit has only 31 judges across the country and a backlog of 16,457 cases of March 31st this year.
“If you file a land case in the Environment and Land Court at Milimani today, the earliest your case will be heard is in 2022. This is because we have a total of 31 judges in the country against a case backlog of 16, 457 as of March 31, 2020,” he stated.
Maraga observed that Uhuru, who raised integrity issues with some of the 41 judges, has no constitutional power to question or reject names recommended to him by JSC for appointment.
“The courts ruled that the president cannot change the list, review it, or reject some names. He cannot decide to cherry-pick from the list of nominees. Both courts ruled the President must appoint the persons as recommended and forwarded to him by the JSC,” n noted Maraga.
“Unfortunately, this disregard of court orders by the President is part of the pattern by the Executive. As your Excellency has pledged in the past, you respect the Rule of Law. I urge you to now demonstrate that faith and respect for the Rule of Law by complying with those two Court Orders. In doing so, you will also alleviate much suffering for Kenyans who are seeking justice in our Court,” said Maraga.

Papa Maraga! Please don’t preach to Uhuru! You have violated the laws of the land many time yourself! Deal with it! Uhuru does not have the time for your nonsense!
Unfortunately Maraga lacks wisdom in addressing the president. Addressing the president in public forums will not make Uhuru listen to Maraga. He sounds like a little boy waiting to be given a candy by the president! In this situation, Maraga will be the ultimate loser and nothing will get done.
The courts are deeply marred in corruption! Deputy CJ still has pending cases and Maraga seem to think that is ok. So, Maraga’s court orders are ineffective at best and Uhuru does not have to honor them! Uhuru is also inadvertently trying to embarrass Maraga by making him sound frustrated which makes Maraga look stupid. The only way to resolve the current situation is for Maraga to eat a humble pie and initiate a formal line of communication with the president.
Uhuru is the president. You are not equal with the president! Uhuru told you Uta do! Just do it no matter the disappointment. Your calling off Uhuru is just like the cries of a frog which Uhuru could care less to listen to! There is no money to hire new judges. You should know that already. The treasury does not have the money to hire judges! You can reach out to some old men upcountry to hold a Barasa to decide the pending cases! Stop whining over your problems you have crated because you lack some basic wisdom instincts! You are your own worst enemy and calling out the president is not helping you!
Why don’t you resign Maraga! There are so many others who are willing to replace you. You are deeply embedded in corruption and ineffectiveness to do your duties.
You are too old to understand what Uhuru is talking to you about; Uta do! In other words, Uhuru is simply telling you to work with what you have at your disposal. He is telling you, get the hell to work!! Just perpetually complaining makes you look like a dummy!
You have failed us all and it would be appropriate for you to quit.
Uhuru will not listen to your baby tun-drums as long as you keep fooling yourself, and acting stupid.
You lack decorum and courtesy in addressing the head of state! You are not equals to the president! The president has many ways to skin your whining to make you look silly.
He can instruct the treasury to cut judiciary funding to embarrass you! Can you do that to the president!? Have you ever heard the word, “revisit issues”? Your issues of 2017. Better humble yourself! You are not Uhuru’s favorite guy!!
We will remember the president many years to come but nobody will talk about you once you leave that CJ office. Learn some manners before you start calling out the president in public places. You should know that already!! You ain’t a kid!!
Hon. CJ David Maraga shld assign the 31 judges 5 Cases a day and to work for 6 days a week so as to clear 930 cases. By dividing 16457 by 930 one wld get 4.5 months. Ie the backlog would be eased by Oct 2020. Allow 4 weeks for petitions.
HOWEVER, this is not the case.... We have idlers for judges.
Every body falls asleep whenever Maraga start talking! Could it be the reason Uhuru is not understanding what Maraga is demanding......?

Many kenyan agree with you maraga. Uhuru cannot just blame the judiciary when he continues to be the biggest hindrance to improving the judiciary. Appoint the judges and restore the budget now!
