Lobby Group wants Quack Doctor Mugo wa Wairimu Charged with Murder

A lobby group has expressed dissatisfaction with the sentence handed to infamous quack doctor James Mugo Ndichu, alias Mugo wa Wairimu.

CitizenGO, which focuses on defending life, family, and religious liberty through online petitions, said Mugo was not prosecuted for some of the most serious offenses he committed.

The lobby through a letter to the Directorate of Criminal Investigations (DCI) head George Kinoti wants Mugo charged with the murder of pre-born babies.

“This is to demand that through your office, the rogue medic John Mugo Ndichu alias Mugo Wa Wairimu be charged afresh with the murder of pre-born babies in his illegal clinic. It is very shocking that this was not among charges against the aforementioned despite evidence of dead preborn babies in his unregistered medical premises,” read the letter by CitizenGO campaigns director Ann Kioko.

Senior Resident Magistrate Martha Nanzushi of Milimani law courts on Wednesday sentenced Mugo to three years in prison or pay a fine of Sh1.4 million.

He was found guilty of various offenses including operating a medical clinic without a license, unlawfully operating an unregistered pharmacy, operating a medical laboratory without a license from the Kenya Medical Laboratory Practitioners, operating a medical clinic without registration, and practicing as an unregistered nurse.

The court ruled that the prosecution proved its case against the accused person.

Mugo was first arrested in 2015 after a video showing him raping a sedated female patient at his clinic in Githurai was exposed by a local TV station. 

The video showed a woman lying on a doctor’s examination table and a man (believed to be Mugo) undressing before climbing onto the table and raping the sedated female patient.

Mugo was charged with rape and 11 other counts including operating an illegal clinic. He was later freed on bond.

I hate to be a prophet of doom, but even the sentence handed to Mugo in the present judgement is excessive, according to law. No one can prove, or testify, that he is a rapist. And he is a licensed medical practitioner, so he can operate Pharmacys and Clinics. Yes, there is a video showing a man raping a sedated woman. Apart from whoever took the video, and said that it was Mugo, there is no other evidence that it is him. The Police should either get the person who took the video to testify, or someone else's testimony, who worked at Mugo's Clinic, to prove the charge of rape. The light Sentence here is not a failure of the Judiciary. They Judge according to Evidence presented before them. The failure is on the Investigative Agencies, ie, the Police and CID, who did not gather the required evidence, which is in the public domain, to secure a Conviction of both rape and murder. They should have looked for the person who took the video, because it was probably an employee. And they should have looked for the rape victim, because she was a patient there. The records must have been there, but the Police chose to ignore them.

I support the motion to prosecute! The funny thing is a woman magistrate let this rapist go nearly free! Very hard for me to understand. Maybe the judge is an accomplice in rape.

Judges and magistrates don't have the power to judge according to news, and public opinion, even if it is convincing. They only have the power to judge according to the charges, and evidence provided by the prosecutor, and brought before them. Mugo was not charged with rape, because the police did not bother to investigate it. He was only charged with not registering a pharmacy and clinic. There are many others who are guilty of this, and they are not only free, but are doing business as usual. It seems as if the police only wanted to be seen to be doing something about the matter, without actually seeking Justice for the victims. Blame the police for a shoddy job, not the magistrate, who was only told that Mugo's only crime was not registering a pharmacy. Nothing else.

Idiot. I am not apologizing for anyone. I am just stating facts. A Spoon is still a Spoon, even if you call it a Spade. You can eat with it, but you cannot use it to put sand in a wheelbarrow. But then again, an idiot like you sounds as if he would insist on doing just that... unless he saw someone else using a Spade to put sand in a wheelbarrow instead of a Spoon.

Mugo, while he was on the run, I met him in a restaurant. I glanced at him and he shot me a scathing "mind your own business" look. I walked away. He was arrested 2 weeks later
