Court Orders Former Nairobi Governor Evans Kidero to Pay KRA Sh427 Million

Former Nairobi Governor Evans Kidero has been ordered to pay Sh427,269,795 in taxes to Kenya Revenue Authority (KRA).

This comes after he failed to prove that the targeted money was raised towards campaigns for his Nairobi gubernatorial bid.

In a ruling on Tuesday, High Court judge David Majanja said Kidero failed to demonstrate that the said funds were raised for the campaigns and utilized for that purpose. 

Kidero, who unsuccessfully defended his Nairobi governor’s seat in the 2017 elections, insisted that the money was raised and used for political party campaigns, making it immune to taxation.

“I agree with the Commissioner that the Respondent failed to discharge his burden as the evidence on record could not support the conclusions reached by the Tribunal,” Justice Majanja ruled.

“Consequently, the Tribunal erred in imposing on the Commissioner the burden of disproving the Respondent’s contention that the KES423,000,000.00 was election campaign contributions when he had not provided sufficient evidence to surmount his obligation to establish this source of income,” the judge added.

An audit by KRA revealed that the funds were wired into Kidero’s personal bank accounts together with other business proceeds.
